Why did Rand Paul get is ass kicked by his neighbor? Because he's a fucking asshole!

.

It turns out, the neighbor wasn't some mental idiot. Rand Paul is just that much of a dick!

Note: Having a shitty HOA doesn't help either.

Here's the the start of the shit that was going on. . .

In September, Paul piled limbs and trimmings from shrubs in a 5-foot-high and 10-foot-long pile near the property line between them. Boucher, who called the pile “unsightly,” after several weeks moved the debris into portable dumpsters and had them taken away.

In October, Paul reconstructed the pile. A few days later, Boucher again had them hauled away. Less than 10 days later, Paul again made another pile of limbs and leaves, again in the same spot. Boucher took his beef to the Rivergreen Homeowner’s Association, but it did not help.

On Nov. 2, Boucher hit some kind of limit with his patience. He poured gasoline on the pile of debris and set it on fire. The resulting fireball gave him second-degree burns on his arms, neck, and face.

The next day, Paul, possibly underestimating the depths of his neighbor’s rage, used his lawnmower to blow leaves from his property onto Boucher’s. Then he piled on the insults: “During this process, Rand Paul stepped away from his lawnmower, gathered several branches from an adjacent pile of trash, and placed them in the exact location where the last pile had been burned just one day prior.”

Then, the ass-kicking occurred because Paul was one of those asshole neighbors, and the HOA protected him.

The prosecutor wanted a 21-month prison sentence, but was reduced to probation.

3. Sounds like it worked out just dandy from Paul's perspective

Libertarians love getting something for nothing. Paul piled up his crap twice, and twice his exasperated neighbor had it hauled away at the neighbor's expense. So much winning, as far as Paul was concerned. But you would have heard his squawks of outrage on Venus if Boucher had turned around and demanded that Paul reimburse him.

Repeatedly, took stuff, lit a fire and the assaulted Paul, and somehow that's Paul's fault? Nope the neighbor is a violent pain in the ass who needs anger management lessons.

that was left there for weeks. I don't know that Boucher went onto his property, just removed stuff that was on the property line.

I think it sounds as if Rand Paul was trying to provoke him after the first incident. Mission accomplished!

42. You are absolutely excusing violence because you don't like Paul

There is no provocation. It's Paul's property. The HOA confirmed it didn't violate their rules. The neighbor can go fuck off. It's not his property. If my neighbor wants to paint his house lime green, and I don't like it, I don't get to go punch him in the face. It's utterly immoral that people are defending this.

Short of a valid threat of violence, throwing the first punch makes you the bad guy. This isn't hard.

That’s an important distinction. Near means in Paul’s side, while on or over woukdnindicate Paul put it partially or all on his neighbors property.

From a legal standpoint it makes all the difference

the sentence - that and the fact the stuff was just trash and the neighbor paid to have it taken away. Doesn't justify violence or say he was not guilty of a crime, but it could mean the sentence is less severe than it would have been.

his 180 degree turnaround act he routinely springs on the senate you'd know what I was talking about. He annoys his GOP pals with threats to vote with the opposition, then gets back on board with GOP at crunch time. It's his character. He knows no one in the senate is going to do him physical harm. I know all about these little chicken shit types.

Paul is not willing to roll the dice by provoking someone he knows could go off on his ass again.

60. ok

Sure ...

Of coarse he is not afraid that anyone in the senate will go off on him, it is a pretty straight forward assumption in most everyday interactions with people that they will not physically assault you, even in verbal conflict. Those that have that fear are the dumb fucks who call the police over loud music instead of knocking on the door and asking them to turn it down.

If, a big if, this man gets no prison time he will certainly get a restraining order against interaction with Paul. He will almost certainly be sued and have to pay out. And if you think after that this man will even get anywhere near Paul you are mistaken. He will most likely move.

How the 535 members of congress play the game has very little to do with their real life. You think those members who always stick to their position and never waiver are what? Bad asses in real life who beat the shit out of anyone who disagrees with them?

I know all about these bad ass mf'ers who never back down ...

that a jury often sympathizes with the defendant because of the irrational/provocative actions of the plaintiff. Such mitigating factors can have tremendous weight in determining the amount of the award to the plaintiff. That said, Paul would probably settle out of court so he can minimize any publicity which would reveal the depth of his obnoxiousness.

"near the property line"

Not on it ... who defines "near"?

Is that ten feet, twenty feet? How can you shove something back onto someone's property when it is already on their property?

How much property? When is heavy trash? Quarterly? Sounds like Paul spent a couple months cleaning up some trees and was stacking the shit. Maybe to dry ... after all throwing gasoline on a pile of wet brush and setting it on fire is a really bad idea, which the neighbor clearly learned.

This website is weird, make no mistake if you reverse the parties this would be treated completely different.

59. I believe the HOA does not allow fences

Or even trees or shrubs along property lines. The old saying "good fences make good neighbors" would certainly apply here, but for the HOA.
Paul got the neighbor to haul away his trash **at the neighbor's expense** twice, and was working on a third time! Can't blame the guy for being pissed although violence is never the answer.
Paul could certainly afford to hire people to do his yard work but it's more "libertarian" to get someone to do it for free.
When house-hunting years ago our #1 rule was NO HOA. Luckily they're not really common around here.

28. According to the article, sentencing hasn't happened yet.

Prosecution asked for 21 months, defense asked for probation.

...

Now, as the neighbor, retired anesthesiologist Rene Boucher, has admitted guilt and is requesting a sentence of probation instead of prison time, more details have emerged about their feud.

In a 10-page memorandum filed Friday and obtained by the Bowling Green Daily News, Boucher’s attorney argued that the prosecution’s request of 21 months in prison was too severe, given Boucher’s reputation as a “pillar of his community” and the isolated nature of the offense.

...

Boucher will be sentenced on Friday.

29. I knew there had to be a back-story.

Not surprised Rand is that big of a dick. Also not surprised the HOA kissed the ass of the Senator and ignored the other home owner. That's the way it works in the South. Title and position means you are untouchable.

30. Sounds like he's living out his libertarian philosophy

I'm sure he things that what he does on his own property is is own business, regardless of what effects it may have on his neighbors. Some might say "That's not being a libertarian, that's just being an asshole", but I say "what's the difference?"

35. There's little doubt that Paul is an arrogant douche,

but the neighbor could have handled the situation better. Perhaps the neighbor should have consulted an attorney to see if there was something legally that could be done, he clearly could afford a lawyer.

85. +1

The HOA allowing it seems a bit strange, too. Usually, when you have those, they want the area looking pristine, so Rand's piles of trash being OK might be more Senatorial privilege and influence than really being OK with piles of trash in a ritzy neighborhood.

43. I hate to say it but reading deeper Paul wasn't in the wrong as far as I see

The reports I see say Paul put the pile of sticks near the property line. Not on or over. And since it was filed by the defense as their account if it was on the line or over it they would have noted it.

So Paul stacks sticks in his property, but near the line.

Neighbor doesn’t like it, goes on Paul’s property and hauls then away.

Keeps doing that and eventually sets fire to the stack, once again on Pauls property.

Gets so enraged over a pile of sticks and some leaves he eventually assaulted someone and inflicted serious injury.

From all my reading while Rand Paul may be an ass it doesn’t sound like he was the party at any point who was legally in the wrong. An asshole for sure to do something you know your neighbor doesn’t like, but not illegal. On the other hand the neighbor seems to be a bigger asshole, who also violates the law when he doesn’t like something.

62. correct

Not a pile of sticks ... depending on depth it would be just over a cord of firewood.

Should someone who stacks a cord of firewood in THEIR yard be beaten? Only if we do not like their politics!

63. That's irrelevant to the matter in a legal sense

As long as he was putting them on his side of the property line, even if it was “near” the line as the accounts say, he can stack them as high as he wants.

If it’s against zoning laws in his area or violates other codes, there is a way to go about that.

Likewise if it violated the HOA rules the HOA has legal remedies. And if the HOA refuses to do their job then the neighbor can take legal action against them and Paul in civil court.

I doubt anything in KY law says if a pile of stick exceeds a certain size neighbors can just go on private property and remove it or set in on fire.

61. Pretty lienient HOA if you ask me

My experience is that most HOAs or condo associations strictly regulate outside appearances. I can't imagine an HOA that's ok with an owner leaving a big pile of brush in their yard. That devalues the homes in the entire community because who wants to live next door to someone whose yard is full of unsightly yard waste?

I'd bet there's a clause in there, right below where they crossed out the section on being white.
