Michael Cohen's attorneys have left his case. Cohen is likely to cooperate with federal prosecutors

Michael Cohen's attorneys have reportedly left his case. Cohen is likely to cooperate with federal prosecutors, sources tell ABC News.


As attorneys for Michael Cohen rush to meet Judge Kimba Wood’s Friday deadline to complete a privilege review of over 3.7 million documents seized in the April 9 raids of Cohen’s New York properties and law office, a source representing this matter has disclosed to ABC News that the law firm handling the case for Cohen is not expected to represent him going forward.

To date, Cohen has been represented by Stephen Ryan and Todd Harrison of the Washington and New York firm, McDermott, Will & Emery LLP.

No replacement counsel has been identified as of this time.

Cohen, now with no legal representation, is likely to cooperate with federal prosecutors in New York, sources said. This development, which is believed to be imminent, will likely hit the White House, family members, staffers and counsels hard.

Everything tilts or curves downward at the edges - the eyes, the eyebrows, and the mouth.

If I were ANY of these attorneys, I wouldn't have wanted to get involved with this bunch for any load of publicity or presumed payment (watch 'em get stiffed, which is trump's style of "doing business". The mark of trump is a professional buzzkill, I suspect. I think it was repentant Republican Rick Wilson who first stated that everything trump touches dies.

1) He is unable to pay their bills.

and/or

2) He will not take their advice.


I suspect it's both. His lawyers have expressed concerns about costs, which a lawyer would do if they were afraid the client couldn't pay.

And I suspect they are advising cooperation and he may be resisting.

But he is absolutely fucked.

I'm mostly kidding, but this news does make the next steps so much more intriguing.

Clearly Trump is the big fish, and I'm sure Cohen has dirt on him, but what does he have? And what kind of evidence is there? Tapes? Emails?

And while the most important thing is bringing Trump to justice, I'd be lying if I said that I wouldn't be disappointed in not seeing the rest of them go down.

But what this "cooperation" could do is lob a hit from an entirely different angle (money laundering from other countries, etc) outside of what Mueller is doing (primarily Russian collusion), although it's possible that any info "relevant" to Mueller's investigation (maybe Russian mob $$$?) could be passed over to Mueller.

So maybe they weren't getting paid. That law firm had quite a few people working 24/7 going thru the documents and that was very expensive. What a waste of money especially since Cohen damn well knew there wasn't much privileged info in there.

While not getting paid is a common reason for submitting a motion to withdraw as counsel, courts aren't wild about granting those in criminal cases if it would leave the defendant without effective assistance of counsel.

Unlike doctors, dentists, plumbers, or any other professional, the Constitution does grant a right to a lawyer (if you are a criminal defendant).

If a private lawyer is not getting paid and wants out, many judges will take the position that the lawyer should have sought a bigger retainer up front before marching halfway across the river.

Coupla things:

If his attorneys have filed a motion to withdraw, that will show up on the electronic docket in a little while.

If you represent a client in a court proceeding, you can't just bail out unless the court grants you permission to withdraw. They would have to file a motion to withdraw, and the court would have to grant that motion. So, perhaps someone is aware of the motion in the short time gap between it having been filed, and it showing up on the docket.

There are some narrow reasons why a court would grant that motion. If, say, the client was insisting on an illegal or unethical act, the lawyers can get out on that basis (through one of two routes). The other would be that the client has fired them (if, say, Cohen has decided to fall on his sword).

You don't really like to see too many instances in which the lawyers for a criminal defendant are allowed to leave. Sometimes the court can order them to stay on in an advisory capacity to the defendant, even if the defendant doesn't want them. The reason for that is that some criminal defendants are perfectly aware that by disrupting the attorney/client relationship, they can try to set up a situation where they can appeal on the basis of ineffective assistance of counsel.

In general, you WANT to see criminal defendants well represented, because the Sixth Amendment requires it. If they are not, then it is one of the ways in which a conviction can be challenged.

44. There is no motion on the PACER docket as of this moment


I just checked the docket a minute ago.

There can be some time lag between stuff being filed and stuff appearing on the electronic docket. The SDNY is usually pretty quick.

Even if it is at the request of the defendant, a court will NOT allow a criminal defendant to go unrepresented absent some further proceedings on competence to do so, etc..

But, no matter what the cause, in order to have his attorneys withdraw, there needs to be a motion filed to that effect, and an order granting that motion.

Perhaps a motion was filed and is not visible on the docket yet, but the attorneys can't leave the case - even if the client wants them to - absent permission of the court.

They the attorneys told him sure they would continue to carry his case but he had to pay upfront...

And Cohens case is in SWNY not sure Don the con has much pull with that grp of prosecutors.

In his pictures from the Huffington Post story about this development, he looks like someone who's been up for two or three days without sleep. Too bad it's because he's worried about saving his own bacon, and not a sense of responsibility for the damage he's helped to incur on our nation, that's making him look that way....

Both he and Manafort have some really, really bad people who'll come after them if they flip. They will send them a message they can be gotten anywhere in the prison system, which is where they're heading. They also know many of these people can never be trusted. End of the day they'll both be flipped, and probably closely protected.

In order to review all of the documents seized for privilege issues, I heard that Cohen's law firm had 10 to 20 attorneys working full time just on this one project. At New York rates, this would add up to $50,000 to $100,000 per day. I suspect that Cohen is running out of funds necessary to review all of the documents seized by the FBI and so is having to get new attorneys
