He wasn't being questioned at the time as any part of a probe. There are legal hurdles that must be hit in order for these things to happen.

Comey and other officials have already stated that Trump's statements to Comey as recorded in Comey's memos are part of body of evidence Special Counsel will be examining for possible obstruction.
