Stormy Daniels Warns Trump & Lawyer: You Breached Our Agreement, Now I'm Free to Talk!

Stormy Daniels has suddenly changed her position and is ready to spill all the tea regarding her alleged affair with Donald Trump, and it all has to do with the president’s personal attorney allegedly breaching a contract he negotiated with the porn star.

Sources close to Daniels tell The Blast that her legal team notified President Trump’s legal team, including attorney Michael Cohen, that they are in violation of the agreement they made back in 2016.

Cohen said on Tuesday that he had paid a pornographic actress $130,000 out of his own pocket in 2016 who had claimed to have had an affair with Trump. Cohen stressed that “Neither the Trump Organization nor the Trump campaign was a party to the transaction with Ms. Clifford, and neither reimbursed me for the payment, either directly or indirectly.”

We’re told Daniels — real name Stephanie Clifford — believes Cohen’s admission is a breach of their contract, and that she is now excused from “further performance of the non-disclosure agreement” between the two parties.

39. Oh, I believe it... tRump* obviously insisted on his usual non-disclosure agreement...

...he requires ANYONE that works for him (mistresses included) to sign one. Since attack dog Cohen may have just violated the terms of their agreement, she is now *presumably* free to sell her story to the highest bidder.

4. Not exactly correct.

He said he used his own money to facilitate payment, not that he paid her the $130,000 directly from his own funds. He also didn't say that drumpf personally wasn't involved. So Cohen used his money to set up the account, transferred Hair Furor's $ there, paid the porn actress.

11. it's not clear what part of the statement supposedly breaches the nda.

i agree with your point, and from a legal perspective, stormy should proceed with caution.

good form to inform the other party of the alleged breach and allow them a chance to respond and explain why perhaps it's not a breach after all.


of course, i'm hoping it all blows wide open,....

This alone however does not necessarily constitute a breach large enough to void the rest of the agreement.
It may only mean that Daniels is allowed to pursue financial damages for the NDA being made public by the lawyer.
it is for a judge to say if not clearly defined in the agreement

25. right, devil's in the details.

revealing the existence of an nda could very well be a breach, and in this case it could be quite consequential.

her interest is in selling her side of the story, and her lawyer could very well have structured the nda so that almost any way in which donnie (or his lawyer) publicly acknowledges the deal or the relationship voids the restrictions on her selling her side of the story.

regardless, in all likelihood this is settled with an additional payment.

Yes, that's one possibility but she and her advisors would have to compare that to what she might be paid for interviews, articles, appearances and/or a book. I wouldn't buy it but a book could be in the seven figures. Would Trump be willing to match a payment that high?

Cohen just publicly admitted that:

1. There was a settlement agreement
2. The amount of damages paid per said settlement agreement.
3. The party responsible for paying those damages was Trump.
4. Disclosed the name of the beneficiary party to the settlement payment, Ms. Clifford.

I'd say her attorneys have good cause to say he violated the terms of the NDA.

And best of all, he just opened a huge can of worms regarding the source of the funds. He really didn't help the situation by saying he paid for it out of his own pocket, and never received reimbursement. If he wants to stick with this story, I'm guessing there will be either an ethics, campaign finance or tax law violation in his future.

49. true, but this is likely a very small agreement.

not like an agreement with 120 parts where you can violate one part and get a remedy for that while keeping the rest of the agreement intact.

in this case, there are likely very few provisions and there's not likely a way keep the bulk of the agreement in place while a provision such as "don't publicly mention this agreement" is violated.

stormy daniel's lawyer likely set up the agreement such that if his side can blab about it, then so can she. which essentially means the nda is kaput.

From her point of view, if Trump sues her, that just perpetuates the publicity she's getting. The publicity is worth much more than $130,000 to her. Her own attorneys will counter-sue. It can go on for years and she's raking in the bucks from personal appearances, book and TV deals, etc.

If they wanted her to be quiet, they should have paid her millions for her silence. $130,000 is chicken feed. She can make much more than that by reaping the publicity and notoriety this brings.

Meanwhile, the publicity can't help Trump. And Mueller is writing it all down. It could lead him to interesting places.... organized crime?

Nobody just hands out 130-grand like that, out of the goodness of his heart, to buy someone's silence, and then leaves it at that. Especially if it was somebody else's transgression and not his own.

Cohen parsed his words. He specifically mentioned not being reimbursed by the Trump Organization or the Trump Campaign. That's it. I'm positive he was reimbursed, just by a different player in this scheme. Reporters really do need to keep asking him was he reimbursed, and by whom.

Knowing Trump, he probably had his slush fund of a Charitable Foundation reimburse the $130,000. I mean, if you really think about it, what Stormy (aka Ms. Clifford) did pretty much amounted to a charitable act in the first place. Actually, don't think about it.
