Federal judge has blocked President Trump's unlawful order ending DACA -grants nationwide injunction

*BREAKING* A federal judge has blocked President @realDonaldTrump's unlawful order ending the #DACA program and granted our request for a nationwide injunction.

20. There are hearings as to the legality of the way he rescinded it.

It's not saying DACA is the law. It's saying that the process he used to rescind the memo didn't follow the required publicize proposal, review it, take comments, etc. APA stuff.

It's also not saying that DACA is legal. And previously it was pointed out that it doesn't matter if the promulgation of the DACA memo also failed to follow the APA requirements--they sort of did that after the ball was rolling, but once established however irregularly it must be dealt with as a fact on the ground.

26. Sounds like they are saying DACA can't now be rescinded even if congress doesn't do anything ?

Even though DACA was never passed into law in the first place, if it can't be rescinded, doesn't that essentially make it a law?

27. No, even if the states prevail in court, it would only delay Trump's action.

My understanding is that a best case scenario outcome would be that Trump is required to follow the APA and have a notice and comment period before withdrawing DACA. Even this outcome is questionable, Obama's position was that DACA or DAPA did not fall under the APA, but some court ruling suggested he may have been forced to comply.

So while the turnabout is rather ironic, whether Trump can be forced to comply with the APA in withdrawing an order that was not issued under it is question well above my pay scale.

35. The federal courts could suffer funding cuts, but that would leave state

courts.

Without federal courts, no immigration laws could be enforced. That would mean that if an immigrant, let's say for example, an immigrant who entered our country legally, committed a crime, the immigration court would not be there to deport him or her. That person might end up in a state prison rather than be sent out of the country.

So defunding or cutting the funding for federal courts would not help Trump.

Congress needs to enact a DACA law, an immigration law.

It is very difficult to live in a country if you don't know the language of that country well. The DACA applicants are American in terms of language and culture. It would be difficult for them to go to the countries in which they were born.

I knew my great-grandfather when he was very old. He went as a 12-year-old with his father to fight in the Civil War for the Union. He came to this country as a child. No one knew that until he died and we found his Taufschein, which is German for his German baptismal certificate. He was not born in this country. He was brought in by his parents. Today we would consider him an "illegal" because he apparently did not go through immigration procedures.

Our immigration procedures were not always as clear as they are today. Many of US would not be here if our ancestors had been so rigorously categorized and questioned before they entered the US.

I side with the DACA immigrants as long as they do not commit the crimes for which immigrants are deported.
