Harvey Weinstein hospitalized after his return to New York from upstate prison

Source: AP

Updated 3:22 PM EDT, April 27, 2024

NEW YORK (AP) — Harvey Weinstein’s lawyer said Saturday that the onetime movie mogul has been hospitalized for a battery of tests after his return to New York City following an appeals court ruling nullifying his 2020 rape conviction. Attorney Arthur Aidala said Weinstein was moved to Bellevue Hospital in Manhattan after his arrival on Friday to city jails.

“They examined him and sent him to Bellevue. It seems like he needs a lot of help, physically. He’s got a lot of problems. He’s getting all kinds of tests. He’s somewhat of a train wreck health wise,” Aidala said. A message left with the hospital was not immediately returned Saturday.

Frank Dwyer, a spokesperson with the New York City Department of Correction, said only that Weinstein remains in custody at Bellevue. Thomas Mailey, a spokesperson for the state Department of Corrections and Community Supervision, said Weinstein was turned over to the city’s Department of Correction pursuant to the appeals ruling. Weinstein had been housed at the Mohawk Correctional Facility, about 100 miles (160 kilometers) northwest of Albany.

On Thursday, the New York Court of Appeals vacated his conviction after concluding that a trial judge permitted jurors to see and hear too much evidence not directly related to the charges he faced. It also erased his 23-year prison sentence and ordered a retrial.

Weinstein remained in custody after the appeals ruling because he was convicted in Los Angeles in 2022 of another rape and was sentenced to 16 years in prison.

If the answer to even one of this is yes then I wouldn't be willing to wager money on the CA surviving the appeals process.

What does Harvey Weinstein's case overturn mean for his California conviction?

(snip)

Weinstein will now likely be transferred back to California to serve the remainder of his sentence for his conviction of rape in 2022.

He'd be transferred, and the CA sentence starts at day 1 of that sentence. Time served in NYS is not concurrent.

The food in Bellevue is probably better, and the beds more comfortable.

It's quite common for inmates to delay a transfer with a fake "medical emergency" that will result in a few days of better conditions. Some inmates will start a fight to get a disciplinary hold while they resolve the matter, in order to delay their inevitable return to penitentiary. Usually it's because conditions are better, but it's often just for a change of scenery, even if for a short while.

I mean, I have blood drawn for various indicators but have no control over the results? I'm free to track down the technicians and threaten them but I can't, not easily. (Or is this a positive trait now?)

HW's still incarcerated. Unless there's a vast HW conspiracy to manipulate reality.

Don't fallow the science.

If and when the tests come back that he's alright, then he'll either find another way to delay, or he'll be sent back to wherever he'll do time.

I didn't see where he has had the tests done yet, or where anything has been found wrong with him, just that he's been hospitalized to take the tests.

I doubt there is some conspiracy, he's probably just lollygagging in a comfy place. I remember his performance with his walker going into court, this seems like another act.

As long as he’s in prison he can live to be 100. Death is too good for him.
