How is it legal to DNA test someone w/o their consent or a warrant?
Just heard on Livestream from Occupy LA that they are DNA swabbing everybody that they have arrested. :grr:

1. Highly unconstitutional to any reasonable scholar, in practice, basically overlooked.
If you're "arrested" you're fair game, even if these people wind up being released in 12 hours (which is likely given the state of LA jails). It'll help them build their DNA profiles though.

identify people. This was inevitable, whether it's legal now or not. DNA is accepted as evidence of guilt or innocence completely on it's own merits, without any other corroborating evidence.

Why DNA would be needed in this case is beyond me though. What use would it have if these people went to court? To prove they were there? That's ridiculous as OLA member would proudly insist they were there.

So my conclusion is the authorities are busy building a national base of DNA for as many citizens as it can. Just because they can. That's the way police states think and function.

It's beyond being a debate on whether the law is doing the right thing or abusing our constitutional rights at this point. It's a fact of life now, like Bush's administration and all the harm that's come from it. We are left to deal with it. Their disregard for all things constitutional has had the effect of a steamroller flattening all our cherished ideals as a Democracy. We can cry and scream and complain all we want. The deed is done and now we have to deal with the consequences.

This has been their strategy from the beginning. If we stop to reflect we will see this is the case.
