It seams to me like domain-name squatting. Can someone with no affiliation squat on a patent just because the other guy(s) didn't move quick enough?

4. Fighting patents, trademarks etc is a real PITA
Prior art should be definitive but sometimes the PTO is deaf dumb and blind.

7. IF it gets that far, the TM opposition phase...

...after approval by the Examining Attorney, allows 30 days in which anyone who would be "harmed" by registration of the mark to oppose registration on about 6 or 7 pro forma grounds.

The outfit which obtained registration of the popular "Smiley Face" of the 1970's was a real bugger for a number of years.
