5. I don't think that President Obama wants to appoint her period
If he did, he would have sent her nomination to the Senate.

7. He could then do the recess appointment, explaining that the Senate had failed to act
Clinton, Bush, and even President Obama have done this. What they have not done is use a recess appointment for a nomination when had not yet been submitted to the Senate.
