5. From a legal standpoint, its an inapt comparison

Manson personally planned and directed the Tate killings. That's significantly different, from a legal standpoint, from publishing an ad with crosshairs on Congressional districts saying the representatives serving those districts should be defeated.

Put another way, if Manson had published an ad with a map showing crosshairs on certain houses saying the people in those houses should be targeted to lose their jobs and he had no direct contact or communication with people who then went out and killed the people in those houses, Manson wouldn't be in jail today.

Palin's ad was wholly inappropriate political discourse and should have been condemned by those on her side when it was published. But the Constitution protects a lot of speech that is inappropriate.
