Justice Scalia: The State Of The Union Address Is A 'Juvenile Spectacle'
As poster arster put it "attending tea party fund raisers, much more dignified... "

In remarks to the conservative Federalist Society on Thursday night, Supreme Court Justice Antonin Scalia decried the "juvenile spectacle" that is now the State of the Union address, saying he believes it is inappropriate for justices to attend the annual tradition.

Comparing the gatherings to "cheerleading sessions," Scalia said, "I don't know at what point that happened, but it did happen, and now you go and sit there like bumps on a log while applause lines cause one half the Congress to leap up while causes the other half to leap up. ... It is a juvenile spectacle. And I resent being called upon to the indignity."

Article II Section. 3. He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.



SCOTUS has no constitutional role at the SOTU.

13. The Constitution doesn't require....
...a State of the Union Address, in person, on television, before a joint session.

19th century presidents used to send a written report, which was then read -- if not just accepted as read by unanimous consent -- by a clerk.

There are better arguments against Scalia's statement than this....

not how it is delivered, just my view on this. It could be sent over in morse code and Scalia would still have an issue... due to the color of the skin of the man sending the morse code.
