Prop8 proponents motion will be denied.

Temp Stay will be lifted....

We don't hear anything about remedy in the MSM.

On Edit: There was a temp stay issued by Walker.

From Walkers Ruling:

REMEDIES

Plaintiffs have demonstrated by overwhelming evidence
that Proposition 8 violates their due process and equal protection
rights and that they will continue to suffer these constitutional
violations until state officials cease enforcement of Proposition
8.

California is able to issue marriage licenses to same-sex
couples, as it has already issued 18,000 marriage licenses to same-
sex couples and has not suffered any demonstrated harm as a result,
see FF 64-66; moreover, California officials have chosen not to
defend Proposition 8 in these proceedings.



ON remedy:

Declaratory remedies are sought when a plaintiff wishes to be made aware of what the law is, what it means, or whether or not it is constitutional, so that he or she will be able to take appropriate action. The main purpose of this kind of remedy is to determine an individual's rights in a particular situation.

1. Judge Walker did issue a temporary stay on the ruling pending a hearing for a stay (until appeals
are completed).

2. But the stay is only until Friday when he hears the arguments for the stay...
...he could lift it then or keep it...I would assume lift since their whole argument is about the "harm" of gay marriage and his ruling b-slapped that down.

3. I read the motion...all it's points were slapped in the ruling...
They were expecting a more narrow focus on the ruling I bet...

What arrogance.
