Fake military hero to be sentenced
Man posed as decorated Marine, was convicted of fraud counts

Sgt. John Rodriguez cut an imposing figure when he was introduced at the Republican committee meeting in the winter of 2008.

The decorated Marine and aspiring precinct committeeman came to the event in his green service uniform with some of the military branch's highest honors clearly visible, including the Navy Cross.

Within a year, the truth was out: Rodriguez, 31, was never in the Marines but had spent years passing himself off as a war hero, gaining access to military bases, getting discounted airline tickets, going to the Marine Corps Ball and briefly getting a job with a local health-care provider that gave him access to sensitive information on veterans.

Rodriguez, a former Scottsdale resident, was convicted this month of 12 felony counts of fraud and forgery, most of which carry a presumptive sentence of two to five years in prison. Rodriguez's attorney did not respond to multiple requests for comment.

Rodriguez was not prosecuted under the Stolen Valor Act, which a federal judge in Denver ruled last month is an unconstitutional infringement on free speech rights.

6. Here's more info on the Denver ruling:
Attorney Chris Beall, who filed a friend-of-the-court brief on behalf of the ACLU of Colorado, said the decision is remarkable.

"The First Amendment protects speech we don't like," he said. "We don't need the First Amendment for speech people like. The government cannot criminalize a statement simply because it is false, no matter how important the statement is."

Beall points out Strandlof wasn't charged with stealing money meant for the veterans group, adding that laws are already in place for those crimes.

"That's plain-old, regular-vanilla everyday fraud, and we do prosecute that every day," he said. "Congress does not need a special statute to prevent people from using false claims of valor in order to prevent fraud."

Sorry an military medal is not just an exercise in "free speech".

It would be like saying lying that you have a liquor license, degree in medicine, or license to practice law is "free speech".

I do agree a guy lying about military service in general terms is not criminal (although it does make him/her a scumbag).

However a military honor is something given by the government to the individual much like any other governmental "award"* like law license, doctors license, or liquor license.

I hope this judge's precedent is overturned. If not I am going to call myself a lawyer without a license and say any laws prohibiting that are a violation of my free speech.


* In this instance I don't mean "award" as is a prize but rather something granted to select individuals at the discrection of the government.
