15. Been a couple of surprises so far on the prosecutors
The defense is arguing accidental and poor training having agreed that he did shoot the victim. Its going to be a harder case to win than many believe.

19. The crux is if he intended to shoot or tase the victim
If he intended to tase him, its an accident or negligence at worst, not murder. Even one of the prosecution police experts admitted on the stand that he too had drawn his weapon instead of a taser in his career.

A former cop and a friend of mine told me that in his dept they always carried the taser on their weak side (left side if you were right handed) to help prevent just such accidents from happening.

Right now I have seen nothing that supports the assertion he intended to shoot him. However the dept is wide open to civil suit and justifiably so.

20. Its kind of stupid of him to intentionally shoot him in front of a train load of people...
half of them with cell phone cameras. I am no friend of cops, in general, but his murder charge is a railroad job by prosecutors intimidated by fervor of the masses in Oakland. He could not have gotten a fair trial in Oakland, period.
