New York - WABC, May 3, 2007) - The air traffic controllers who were exposed to that carbon monoxide now want a criminal investigation into why they weren't allowed to leave their control center, even though they were dizzy and disoriented -- and trying to direct hundreds of planes.

"It was like a fog," said controller Ray Maldonado.

"Sometimes it felt like I couldn't clearly put together something that I normally would have at any other time. You know what I mean?" air controller John Conklin said.

"I remember just being extremely fatigued ... very tired, very sleepy. It took a lot to stay awake that night," Maldonado said.

"Headaches, nausea, dizziness, disorientation, fatigue, inability to focus, not able to concentrate. We had these employees who were in no condition to do this job being directed to continue with this job," said Iacopelli.

"They said, 'no, we're not calling the fire department,'" Conklin said.

"The employees there said, 'Well, we'll call the local fire department and have them come in to test the air. And the operations manager in charge informed them that, 'If you make the call, I will not let them in the gate and I will refuse them entry into the control room,'" Iacopelli said.

Sounds like DOMESTIC terrorism to me. In New Jersey, of ALL places!!! Hmmmm...

I've yet to see this ANYWHERE but on DU (thanks to flyarm) and the ABC affiliate. That's all, folks. Nothing to see here.

Can't get much clearer than that.

WE, THE PEOPLE, have circulated information across this country post 9-11 without ANY assistance from the MSM. We have fought our way out of the darkness and we can do it again. WE HAVE THE POWER BECAUSE WE HAVE TRUTH.

If I denied an individual the opportunity to remove themselves from a room (garage) that was filling with carbon monoxide...if I denied them opportunity to phone for help (Fire Dept.) or vacate to safety and then THREATENED that if HELP ARRIVED they would be DENIED ENTRANCE...

MY ASS WOULD BE IN JAIL FOR ATTEMPTED MURDER! As it well should be! It's that simple. What do they mean there "MAY be a criminal investigation"??? There WILL BE a criminal investigation. WE, THE PEOPLE, will DEMAND IT!

I am spreading this story far and wide. I have friends who own travel agencies and friends who work in the airline industry. This act of domestic terrorism must be brought to justice. IMMEDIATELY.

WE ARE THE MEDIA. We have functioned as such since the "traditional" media has abdicated its responsibilities to this country. WE KNOW WHAT TO DO! Let's get busy!!!

There is NO WAY that they can SPIN this. It was a DELIBERATE act. Now, we need to arm our fellow citizens with TRUTH so that we all can safeguard ourselves against this type of criminal activity.

Clearly, "to coerce or intimidate governments or societies, often to achieve political, religious, or ideological objectives" doesn't apply here. Yes, it sounds criminal, and there should be an investigation.

yes they were compromised when they were getting sleepy from carbon monoxide poisoning.

and yes, if there had been a hijacking in any of the planes they were in charge of ..they probably could not have done the job that needs to be done in a terrorist attack becaiuse they were compromised in their thinking and actions!!

well that entire control center was even worse than being drunk! The had toxic exposure that was limiting their cognitive thinking and their motor skills.. they were a danger to everyone in the air and on the ground under those aircraft!

this was worse than just criminal..this was dangerous in so many ways!!

remember newark Airport is surrounded by Oil storage tanks..huge huge oil storage tanks...
there is giants stadium close by...in the meadowlands..

THERE ARE ALL THE NJ/NY BRIDGES AND TUNNELS

by air those places are close..

thAT air traffic control center, could have been closed and planes diverted to Philly and to LGA..and possibly Baltimore..

until new controllers were brought in..or an immediate testing of the air quality BY FIRE PERSONEL..when it was understood that there was a problem!

after all diverting happens all the time because of weather!!

30. CRIMINAL CHARGES need to be brought against their supervisors.
The actions of those in charge are so out of line, it boggles the mind. And ALL of the supervisors who ruled on this need to be fired IMMEDIATELY. I'm way over tired of criminals with important positions in our government NOT having to pay for their misdeeds.

39. Something VERY similar to this happened to a group of employees
where I worked, at the Michaels Stores, Inc.'s corporate offices in Irving, TX, in 1994.

Our offices used space in half of a warehouse-type building -- the usual cubicles-n-pods set-up, like in any other modern office in our half of the building, and a huge warehouse storage area for merchandise in the other half.

Trucks unloaded items from all over the world directly into that warehouse on a daily basis, and more trucks took them out and shipped them to Michaels Stores all across the country.

The "gassing" incident involving about 40 employees occurred because a semi-load of lacquered decorative boxes from China was stored in the warehouse half of our building, and the powerful fumes (which had NO ODOR) from that lacquer that had not fully dried and cured yet came right through the ventilation system which circulated between the warehouse half and the office half of the building.

This stuff was absolutely horrible -- and for some of us, blinding and crippling, while almost everyone exposed for over a week had headaches and problems concentrating and focusing. A few of us experienced violent nausea or otherwise got so sick we had to leave the building.

I was one of those, as was my friend two cubicles over, and one other employee -- we all happened to be women, btw, and one had a history of severe allergies. I had no such history or any special sensitivities, however, and the other lady didn't either.

Of all the employees who were bothered enough by these toxic fumes to complain about the situation, only we three stood our ground and refused to go back into the building until it was tested by OSHA or somebody!

I could tell there was something in that building because when I went outside to breathe the normal "clean" Irving air, all my symptoms went away in about 15 minutes. When I went back into the building, the symptoms came back FAST and HARD.

I went home that day and tried again the next morning. Same shit. Only now we three ladies would get SO sick SO fast after we entered the building again, we couldn't even get to our desks!

Story ends with the corporate heads covering their asses in a big way, having the air tested by "the proper authorities" (we never could find out just who that was) and declared "safe" or "within tolerable limits" or somesuch crap, and telling all employees who believed otherwise we could return to our desks and our jobs or be fired.

It was that simple -- and no one challenged them on legal grounds, probably because none of us could afford to do so.

And the corporate heads knew it.

Cost all three of us our jobs because we just could not function in that toxic air and were not willing to even try beyond what we'd already done.

One lady "captured" some of the toxic air in a jar like her doctor told her to do and took it to him to test, but I never heard how that came out. Our bosses panicked when they saw her doing that, however, and that's when the shit hit the fan.

The corporate heads also intimidated our doctors into changing their documented opinions of what caused our mysterious ailments! So our legal leg to stand on was kicked out from under us by the power of the corporate elite.

It was not a case where they forced or compelled us to stay in the building, locking us in, but they did everything but! If I hadn't been so concerned about our health that I dug in and wouldn't budge on my refusal to return to work, the other two ladies would have gone back and tried yet again, but they followed my lead -- and lost their jobs too.

To this day, everyone who worked in that building, including the mid-level execs for that department, KNOWS what happened.

My friend and I did the research, found the cause, even dug up some shipping paperwork that had WARNINGS on the merchandise from China, stating that those lacquered boxes MUST be "stored in an open-air area for up to three days to allow the lacquer to completely dry" in order to be safe!!

The lacquer came from a tree in China who's nickname is "the headache tree," because people reported that they would get headaches if they so much as walked within ten feet of one of those trees growing in the wild!

Yet this lacquer was a concentrated form of the tree's sap or bark or whatever, and it was applied to the boxes (by employees in China who probably dropped like flies but who cares -- or hears -- about THEM?) and then the boxes were shipped wet or barely tacky to their destinations.


Expect the defendants (the government, the supervisors, execs, whoever) to deny all culpability in this case of the air traffic controllers rendered sick and incapacitated by some gas or fumes in their workplace. I heartily agree that this should be a breaking news lead story due to the extreme intimidation and threats involved -- and of course the critical, life-and-death nature of the controllers' jobs!

NO WAY should this action be allowed to go without a challenge or exposure to the wider world.

I hope any workers involved in the legal battle don't suffer even worse from the behavior of the defendants and their army of lawyers than they did from the fumes that laid them low. It's incredible just how far some soulless entities will go to protect themselves and cover up their parts in such blatantly wrong and harmful acts.

It's even more disturbing that very often such dastardly wrongs go unpunished and the perpetrators of bodily harm and emotional distress remain on the payroll with unblemished records -- and even promotions and raises!

My friend from the Michaels Stores incident has never fully recovered her health and was unable to work at all for several months. The third lady was young and tried to just forget about it, moving on with no lasting damage (that I know of).

I learned never to trust employers, period. They're not in business to make life pleasant or even tolerable or safe for their employees.

And apparently money talks and corporate influence walks right over the wounded left behind in the dust ... and the fumes.

45. Not a surprise, true. But at least the Chinese company provided its customer,
Michaels Stores, with a warning typed in all caps IN RED LETTERS across the shipping documents, instructing the buyer to store the boxes in the open air for three days. I suspect that crap would have been toxic even if Michaels had left it out for three days and THEN put it in the warehouse.

But it was the good ol' American businesspersons who paid no heed whatsoever to the warning and put us all at risk of serious illness -- or even death, for all they KNEW. My boss in that same building was their real estate attorney, and even he reluctantly told me he couldn't back me on this one, although he thought very highly of me and valued my work. He was a young fella and a decent guy, but clearly his bosses had told him where the line was he was expected to toe.

In any event, it was the little guys, as usual, on both ends of the shipping spectrum (China and the U.S.) who ended up paying the price in damage to our health with no legal recourse available by the time the corporates were through with us.

What smoked my ass most of all was that, and the fact that the Michaels lawyers or someone in that food chain at the corporate office was able to intimidate doctors who were not ones that were on their payroll.

Helen's doctor was quite adamant and even angry at first about the degree of harm to her health she had suffered, the danger to her if she remained in that toxic environment, and the reason for the physical/medical damage done to her.

Unlike my doc, who pretty much took my word for it, hers behaved like a real physician and wrote down his opinions and a detailed summary of his examination and assessment. He drew her blood and ran a lot of tests. The results were conclusive but were somehow "lost" after the Michaels people got to him. And he changed his diagnosis -- completely re-wrote and modified it! -- to appear that all concerns about the toxic air at the office were "speculative."

Now THAT's scary to me.

The only professional person who stuck by his diagnosis and treatment of Helen's symptoms was a "wacko" chiropractor who was an instructor at the chiro college in Dallas and who also practiced homeopathy and acupuncture. HIS opinion wasn't considered to have enough weight to worry the execs at Michaels and their attorneys. They knew the revised (coverup, inaccurate) diagnosis and prognosis of the MD was all they needed.

It's not easy being green -- and very small.

47. I can speculate as to the likely mechanism by which the Drs were turned against you...
If they do business with Worker Compensation insurance carriers, particularly if that happens to be a large part of their business. The carriers, of course, don't like to pay claims, and if you were to turn up with serious problems due to your exposure(s), if could cost them a ton of bucks. The sick and sad truth of today's health care system in the USA is that the insurance companies are in the position with ALL the power, that means power over us little people, and, yes, in many ways even MORE SO the doctors who rely on them so heavily to pay the bills.

All it likely took to affect the 'needed' change to your diagnosis was the call from the WC insurance carrier to the doctors office, wherein they threatened to remove the Doc from their little list of 'approved' Workers Comp doctors, and you were hung out to dry quicker than you can say Arnold Schwarzenegger, my friend.

My dad's been dealing with this same kinda bullshit around the WC system for so many years now I'm amazed he hasn't gone Virginia Tech on his WC insurance carrier by now. Those companies are literally the SCUM of the EARTH and will do ANYTHING they think they can get away with (and the WC court system that supposed to protect your 'rights' is such a fucking sham, as well, I hate to have to add...)

Sorry about your misfortune, I do totally feel for your plight, as I've been very very close to that same kinda shit for going on 20 years now myself...

55. You reminded me of some things I'd forgotten about the case.
First, I think you probably nailed it with your assessment and explanation.

IIRC, the doctor Helen saw for this purpose was one she was referred to by her regular doc. And he was not only one who participated in the Workers Comp system, he was a doctor who had actually represented many successful cases of workers against employers!

He had an amazing record, in fact, and a sterling reputation in the field and in the community. He was apparently considered to be a righteous sort of guy and was respected by many people involved in such cases, though I can't say now which part of the equation these "believers" in that particular doctor represented. But his evaluations had held up under scrutiny in court cases, his diagnoses had been verified by other "independent" physicians who did some cross-checking for other parties involved, including even the defendants (employers) in those cases ... and his patients had prevailed and won suitable -- but not outrageous -- awards in court.

This is why Helen and I pinned so much of our hope for relief on this doctor in the first place!

I have a little familiarity with the WC system, too, though my exposure was short-lived and many years ago -- actually in 1969, in fact. My boss on one of my early jobs as an executive secretary back then was a WC attorney who won humongous awards for his clients against companies of all sorts -- and in my view at that time, at least, in some pretty "odd" if not outright dubious cases.

That may have been the heyday or the early days of what later came to be thought of as the abuse of the WC laws. That attorney worked in Muskogee, OK, and one of his brothers was a well-known judge locally, while another brother was an attorney who handled cases much like my boss's, IIRC. This family of lawyers, last name of Garrett, was reputed to be corrupt and "for sale" to the highest bidder around town, and they certainly lived high on the hog from their "illgotten gains," according to some insiders I met.

It may have been people like them, I suspect, which eventually drew the attention and the ire of the corporate opponents in their court cases which were taking such big financial hits due to successful WC actions against them!

I know my boss was a creepy character who was more interested in chasing my 19-year-old ass around his desk and wanting me to take dictation from a position on his lap than in appreciating my first class clerical skills! :mad: :puke:

I quit working for him within a few short months due to that behavior of his and even thought about trying to file a sexual harrassment suit against him -- but figured I stood a snowball's chance in hell of winning it considering his success rate in his court cases (admittedly of another type, but still....).

(The guy had divorced his wife of three decades to marry his previous secretary, whom he had gotten pregnant! She was half his age of 62, and they had a two-year-old boy -- and a rocky marriage from what I saw of it.)

It may have been attorneys like that one who brought so much scrutiny to the WC system at that time, for all I know. Certainly the climate changed over time, as did the laws and the rulings, I believe.

As for the corporate bullying of the doctor in the Michaels case by -- whomever, it seems a likely scenario as you paint it, to me. Texas is a state where (as most of us know) the most skulduggerous machinations imagineable go on in every public and private sphere; and this doctor who specialized in cases such as Helen's could have been a target because of his successful record that benefitted "little guys."

I remember considering seeing him myself, though that became pointless once he changed sides. I had even visited his office WITH Helen a couple of times, in order to provide moral support for her and backup, background information for the doc on the details of the events that sickened so many and seriously harmed at least a few. Helen had become quite frail physically AND emotionally by the time this situation had reached that stage, and she tended to panic or just get nervous under pressure and forget to mention important factors.

The doctor seemed to listen closely to my "testimony" in his office -- offered only when he or Helen asked me to respond to questions he had about our exposure and the company's (lack of) response to our complaints and need for protection from further harm at that location.

But that all seemed to change at the same point that this physician changed his story about the cause of Helen's illness! It makes sense to me that insurance companies may well have been involved in persuading him to re-write his records and "lose" the lab test results. Even though this was a legitimate and good case -- in the eyes of some experienced people, at least -- this doctor DID get his bread buttered by the insurance companies that paid out the dollar amounts in claims won and awarded in court.

By 1994, as opposed to 1969, things had changed in the WC system as you no doubt know; and he may have been pressured to abandon us and our righteous case if he wanted to continue to do well in his many other cases. Ya think?

It just burns my butt that he yielded to pressure in OUR situation because no one deserved compensation (and needed follow-up care) much more than Helen did! Her life was ruined, along with her physical and mental health. She ended up being compelled by her circumstances as a divorcee in her mid-50's who had only herself to depend on for a livelihood, to return to work -- but without a good recommendation from her last employer, so she got a much lower position than her previous one (for the head of that department at Michaels) at a far lower pay rate.

Her only child, a grown son, and I were about the only friends she had left by the end of that story. It was heartbreaking to watch what happened to her, for it was much worse than how it worked out for me and the other employee most affected by the fumes.

So yes, I think you may have it right on the money (no pun intended) with your analysis of our case.

I just still can't figure out why that specialist physician who stood by and helped his patients WIN cases against corporate entities before and after Helen's, decided to buckle in HER case in particular ... unless it was some reason only an insider would know or understand.

I remember being quite stunned at the turn of events, as it happened, and "disappointed" hardly describes how Helen and I felt! For awhile it had seemed that every area of importance in the case produced facts that supported OUR side of it. Then suddenly the tables turned and we had NO friends and NO leg to stand on in court.

FLUSHED, is what it felt like. We were simply sacrificed, for whatever reasons of the doctor's, and that was that.

In case you can't tell, I'm STILL VERY ANGRY about what was done to Helen, and to a lesser extent, to me. Who knows what longterm health consequences we or many of the other employees who were unable or unwilling to speak out or stand by their claims may be suffering to this day? Ones which we may not be able to connect to that exposure to toxic fumes, but which may BE connected in reality.

I have had trouble with allergies or sensitivities to a wide range of other substances since then, though they haven't been severe like Helen's. Before that exposure in 1994, I'd never had ANY special sensitivities to anything I knew of except metal against my skin, which caused a minor, irritating rash, and a couple of common irritants in our environment.

Now I have to pay attention to toxic stuff in my surroundings and foods and medications and avoid some obvious danger zones or ingredients. And my lungs have never quite been the same, since I suffered for years after my exposure to the lacquer fumes from chronic bronchitis and even pneumonia. That situation was only reversed for me when my brother, a pharmacist, helped me respond to early stages of such infections with the proper medical care and treatment with drugs.

I shudder to think what ever happened to Helen, who, when I last heard from her, was struggling to keep that lesser job she got, due to her frequent absences for illness and emotional distress....

2 Years ago, I had a 16 foot long 6 X 12 inch beam fall on my back from 7 feet above me. The man that dropped it on me had tested positive for crack cocaine 2 days prior to the accident and was never discharged from his duties. The insurance company, on the other hand, said that my injuries were not traumatic and that my 2 cracked ribs and almost puntured lung was from a pre-exsiting back problem? Needless to say, I was outta work for 6 months, no way to pay my bills, and no way I could wait to go to court for the money. I was forced to settle for less than $10,000. I was a $30/hour employee when this incident occurred. I got only $10,000 for 6 months of lost wages. FUCK THE SYSTEM. None of these bitches are here for your protection. Insurance is the biggest scam ever.

58. i built a new home in NJ and i "had" to have carbon monoxide detectors
throughout the home and even in the garage..it is the law and mandatory..along with smoke detectors...

how after 9/11 can any air traffic control center not have Carbon Monoxide detectors..they can be bought and plugged in now..but ..with any kind of terrorism..how can any Place where people are controlling the safety of masses of people not have the newest detectors for everything..any kind of toxins, and air borne poisons..

where is this homeland security we supposedly have?????????

well the same way that the air space over disneyland is closed( i agree with that by the way) but while the air space over Disney is protected..no air space over any of our nuke plants is protected..no other amusement park has their air space closed...or over any major dam in this country and many many more vital places to all our safety and existance...


believe me, as a now retired flight crew..i assumed ..the control towers would have been one of the first places secured and monitored for any toxins.and guarded in every way...wow was i stunned when i saw this...stunned and damn angry...

homeland security my ass!

remember this ..flights get diverted all the time for weather..yes it screws up alot of schedules..yes it screws up where the aircraft are scattered..but they do it all the time for weather..for goodness sake..

that control center should nave and must have been shut down..

personally i would rather my flight delayed or canceled..than to go up or be up in a tube in the air with air traffic controllers not at their "A" game!

what if there had been an emergency in any of the aircraft that were stacked up waiting to land..or say ..an aborted landing by any of those aircraft???????..there are so many things that could have happened with tragic results because the controllers were compromised.

Air controllers call for criminal investigation

(New York - WABC, May 3, 2007) - The air traffic controllers who were exposed to that carbon monoxide now want a criminal investigation into why they weren't allowed to leave their control center, even though they were dizzy and disoriented -- and trying to direct hundreds of planes.

Eyewitness News reporter NJ Burkett broke the story Wednesday, and has new developments.
If there is a criminal investigation, and there may be, the FAA is promising to cooperate. Now, Senator Chuck Schumer is demanding answers. The question is, why were the controllers forced to continue directing planes while suffering the effects of carbon monoxide poisoning.

Air traffic controllers brought their allegations directly to the Nassau County district attorney this morning, urging prosecutors to open a criminal investigation.

"It just seemed harder and harder to stay awake," said controller Ray Maldonado.

Controllers told us they were so sickened they could barely function, but were forced to remain on their positions for up to four hours directing large commercial jets from the FAA's air traffic control center known as TRACON.

"It slowly started to feel worse and worse," air traffic controller John Conklin said.

"I remember just being extremely fatigued ... very sleepy. It took a lot to stay awake," Maldonado said.

Eyewitness news reported last night that a test of the facility's backup generator sent exhaust fumes into the building's ventilation system, slowly filling the room with potentially-deadly carbon monoxide. Soon, at least half-a-dozen controllers were physically ill.

But the FAA:


Refused to let the controllers leave

Refused to call the fire department to take air readings

"They would have to acknowledge that number one they made a mistake pumping the fumes into the control room. And number two, they didn't have enough staffing to cover ... There would be delays, the airlines would complain. It wouldn't make them look good," Iacopelli said.

Yet that is exactly what the FAA did ten years ago, taking no chances when dust from renovations at TRACON sickened dozens of controllers. There was a partial evacuation then, caused a series of delays and cancelled flights.

American Airlines A300's had no capability of dumping fuel..

this is another good job brownie appointee..a lady who has no aviation background...

could we not find one retired Aviation engineer from say >>NASA??

CHANTILLY, Va. - Fumes from a work site forced air traffic controllers to evacuate their tower at Dulles International Airport and shift to a backup facility Wednesday.
The fumes were reported about 10 a.m., and firefighters ordered the tower cleared, airport spokesman Robert Yingling said. The tower was ventilated and the workers were allowed to return about two hours later, he said.

The Federal Aviation Administration said a contractor was doing welding in a terminal area next to the tower and didn't request permission to weld there.

There's a "possibility that fumes from nearby welding went up an elevator shaft into the tower," FAA spokesman Les Dorr said. Four people in the tower were taken to a hospital for treatment.

The incident had a minimal impact on flights, authorities said.

71. New WABC story: "reckless endangerment", "malicious intent"
WABC has a new story, but still ZERO from any news outlet other than the local station.



"The controllers say it's a case of reckless endangerment, that the FAA took enormous risks knowingly and deliberately. On Tuesday, prosecutors took the first step in what could become a criminal investigation.

Air traffic controllers met with prosecutors face-to-face today -- nearly two weeks after several were overcome by carbon monoxide fumes at the FAA's air traffic control facility, TRACON.

Yet as Eyewitness News first reported last week, they were forced to continue directing planes for up to four hours after TRACON managers refused to call 911 and threatened to bar fire responders from entering the facility if anyone else called.

"I think that there was malicious intent in that. They want to make you sit there and suffer," said air traffic controller Joe O'Brien.

"They made them sit there and work the traffic, and it's only to the dedication and professionalism of the people I work with that calamity was avoided," O'Brien said.

In a short statement released to Eyewitness News Tuesday evening, an agency spokesman seemed to suggest that the only likely changes would involve maintenance procedures on TRACON's backup diesel generator.

"FAA continues to investigate the circumstances surrounding the incident that occurred at the New York Terminal Radar Approach Control facility in Westbury on April 25. A preliminary examination of the equipment and procedures has been completed. At the end of the investigation, if it is warranted, recommendations will be made on how maintenance checks on facility diesel engine generators can be improved," said FAA spokesman Jim Peters.


Nothing about a plan/policy to evacuate air traffic controllers being overcome by gas or fumes. Nothing about procedures/policy for diverting aircraft. Nothing about back-up controllers. Just "if warranted... recommendations on maintenance checks". WTF??!! If that's all the FAA cares about the safety of people, I'd be looking for another job if I were crew or a controller.
