Senate panel backs liberal Liu for S.F. federal appeals court

On a party-line vote, the Senate Judiciary Committee has recommended Goodwin Liu, a Berkeley law professor, for a seat on the Ninth Circuit Court of Appeals, based in San Francisco. If confirmed, he would be the second Asian American on the federal appellate bench.

The 39-year-old Liu, whom Republicans and conservatives criticized as being too liberal, was approved today on a 12-7 vote. His nomination now goes to the full Senate, where he still faces strong GOP opposition. It's not yet clear whether Republicans will filibuster his confirmation.

"I'm in the camp that you can be an active Democrat ... and still sit on the bench," said committee member Sen. Lindsey Graham, R-S.C. "But this guy's a bridge too far for me. He should take those views and run for office."

Liu was attacked at his confirmation hearing last month for his January 2006 testimony against the confirmation of Supreme Court Justice Samuel Alito. "Judge Alito's record envisions an America where police may shoot and kill an unarmed boy to stop him from running away with a stolen purse; where federal agents may point guns at ordinary citizens during a raid, even after no sign of resistance . . . where a black man may be sentenced to death by an all-white jury for killing a white man . . . and where police may search what a warrant permits, and then some," he said in his prepared testimony.
