Kyle objected to Chen's connections with the ACLU and for having "peculiar private views" that are "out of the mainstream." Sessions objected to Chen for his work for the ACLU opposing the death penalty, English only laws, etc.

They objected to Butler accusing him of putting his personal beliefs ahead of the facts/law, for losing an election in the past, and for stating that he modeled himself after Justice Brennen and Marshall (who were "activists" - like in Brown v. Board of education).

Senator Feingold vigorously defended Butler stating that a majority of WI voters in the Western district, where he was appointed to serve, supported him and that it makes no sense to hold a past election loss up as a reason to not support a judicial nominee. He stated that the minority was nitpicking his record by using a quote of a previous colleague (now 7th Circuit Judge Diane Schwerm Sykes) as a reason to not support him because she was certainly an ideologue and both Feingold and Kohl supported her confirmation. Senator Durbin noted that both he and Abraham Lincoln lost three elections before coming to Washington and he was qualified for public service.
