Turley said it's interesting the affidavit (re: O'Keefe, et al) didn't mention
electronic recording devices, which would garner more time.

If you're missing this, check for it on KO's site later, or the rebroadcast. I'm loving what I'm hearing.

Anti-ACORN filmmaker arrested

Federal authorities have arrested four men on felony charges for attempting to infiltrate Sen. Mary Landrieu’s New Orleans office, including one filmmaker who targeted the community group ACORN last year in damaging undercover videos.

Among those arrested was 25-year-old James O’Keefe, the conservative filmmaker, along with Joseph Basel, Robert Flanagan and Stan Dai, all 24. They were charged with entering federal property under false pretenses and attempting to gain access to the Democrat’s office by posing as telephone repairmen, according to a copy of an FBI affidavit unsealed Tuesday.

The complaint said that O’Keefe was waiting in the office when Flanagan and Basel each entered the premises, wearing light green fluorescent vests, denim paints and blue work shirts, tool belts and hard-hats. They informed a member of Landrieu’s staff that they were telephone repairmen and requested access to the main telephone at the reception desk.

At that point, the two men allegedly attempted to manipulate telephones and accessed the telephone closet, saying they needed to work on the entire system. The men, who said they left their credentials in their vehicles, and were later arrested by the U.S. Marshal’s Service soon afterward. O’Keefe was allegedly involved with planning, coordination, and preparation of the operation, according to an FBI news release.

10. Real investigative journalists don't bug phones. These guys weren't trying to be journalists.
They're auditioning for Karl Rove -- or the knew head creep hirer, whoever it is.

According to the articles on this:

A federal law enforcement official said one of the suspects was picked up in a car a couple of blocks away with a listening device that could pick up transmissions. The official spoke on condition of anonymity because the information was not part of the FBI affidavit.

Maybe they are holding these charges out in order to get to the big fish who provided the equipment. Turley said this isn't something you can just pick up.

You're right that there was no mention of any seized electronic gear, but that could have been purposeful. They might not want to reveal all they have, so they can use it against the perps in interrogation and deal making.

I'll be interested to see the big guns who get hired to represent these guys.

I expect the next move will be the issuance of a cover story, maybe more than one cover story. Maybe they'll claim it was boys thinking they were pulling a "Punked" episode, not realizing the gravity of their actions. Or, maybe an allegation that they had found some deep, dark secret about the senator, and wanted to expose it. Either way, they'll try to deflect and make the perps sound youthful, maybe misguided but well intentioned, and in some sense justified.
