DNC Lawsuit to Obtain RNC-Justice Department Communications

One month ago, I hand-delivered a Freedom of Information Act (FOIA) Request to the Department of Justice on behalf of Governor Dean and the tens of thousands of you who added your names to it. The FOIA attempted to get beyond the stonewalling, contradictions and misleading statements given surrounding the firing of the U.S. Attorneys by requesting:

all documents in the possession, custody or control of the Office of Attorney General, Office of the Deputy Attorney General and Office of the Associate Attorney General, prepared on or after November 1, 2004, constituting, reflecting or referring to communications to or from or to any officer or employee of the Republican National Committee or any state or local Republican Party committee, referring, relating to or discussing (1) any prospective or ongoing investigation or prosecution; (2) initiating any investigation or prosecution; or (3) the appointment or termination of any United States Attorney; or (4) the performance, work or activity of any United States Attorney or Office of United States Attorney;


Since then, the Republican National Committee claims they have lost emails from Karl Rove's email RNC account during an 18-week gap. In addition, some of the White House staffers using RNC email addresses may have been used to communicate with the Justice Department about the firings.

Now it's 30 days since the FOIA request and we've filed a lawsuit in an effort to obtain the RNC-Justice Department communications. The stonewalling continues, but this time it's affecting a request by tens of thousands of you.

The Democratic National Committee sued the Justice Department on Thursday, demanding it turn over any e-mail traffic with the Republican Party on the U.S. attorneys controversy and criminal investigations.

Problems involving missing e-mail surfaced in recent weeks at the Republican National Committee and the White House as congressional investigators looked into the department's firing of federal prosecutors.

The Democratic Party's suit in federal court followed the RNC's refusal for now to turn over e-mails to Congress. White House lawyers first will have an opportunity to review them to determine whether some should be kept secret.

With Abu Al and the hyper-extended coverage of the Virginia Tech tragedy sucking all of the oxygen out of the mediasphere this week, you can be excused if you missed some important stories because they were buried. Here are two of them:

DNC -v- DOJ Re: FOIA

Today, the Democratic National Committee sued the Department of Justice for not complying with a FOIA request. What was the DNC asking for? Any emails that flowed between RNC-based internet domains (gwb43.com, etc.) and the Department of Justice, specifically on the topic of the U.S. attorney firings. This might not seem like a big deal, but it’s significant, in as much as the request is an end around the White House being the gatekeeper for similar emails that House Judiciary Committee chairman John Conyers has requested.

Conyers has not yet subpoenaed the emails, though that may yet come. More importantly, the DNC suit opens up a can of worms for DOJ on several fronts. Any claims of privilage by the White House pretty much go out the window for these particular emails, given the source and/or recipient. The DNC had requested FOIA disclosure of the documents back in March, and the DOJ had, by law, 20 days to acknowlege receipt of the request. They didn’t. And now, the DNC is suing to expedite release of the emails because of the failure to comply with FOIA regulations by the DOJ.

This story might seem inconsequential, but it’s not, because it’s a nice little play to ultimately force the White House’s hand and to force the RNC (and White House) out of the legal delaying tactics currently being employed by the RNC.

12. There was one senator who kept talking about the RNC e-mails
during the Gonzalez' hearings and at one point asked aloud how the committee could get them. It was apparent that it was in the forefront of their minds.

This is a good thing.
