Just said it in the Senate Committee hearings today, grilling Holder over whether or not Osama bin Laden would be read his Miranda rights were he to be captured by America.

2. First of all

Osama bin Laden, if caught, will likely be shot and killed on the spot. And secondly, I think he would be the prime candidate for a military tribunal as he has "declared war" on the U.S. Besides, he could never get anything resembling a fair trial in the U.S. justice system.

I never saw where Congress voted to approve a formal Declaration of War against either al-Qaeda or Osama bin Laden. This whole "we are at war" meme has got to come to an end, and it is disappointing to see Holder pressured into continuing this farce.

I mean, we've squandered a trillion dollars, we're on the hook for a couple of trillion more, we've killed thousands and thousands of people who never meant us harm, killed and injured thousands more of our own, engaged in torture, extrajudicial murder, compromised the Constitution, and illegally spied at home and abroad.
