Did Doug Hoffman Actually Win the NY-23 Special Election? If So, Does It Actually Matter?
Narrowing margin in post-election canvass raises hopes for GOP/Conservatives, but recent Republican-set precedent may well dash that hope...

A potentially interesting situation is underway in New York's 23rd Congressional district where post-election canvassing of the recent Special Election for the U.S. House is still underway.

According to Syracuse's Post-Standard, the post-election canvass shows the race between Conservative Party candidate Doug Hoffman, who conceded on Election Night, and Democratic candidate Bill Owens, who was sworn in as the district's new U.S. Congressman last Friday, to be tightening as results are double-checked, errors are being found, and a few thousand absentee ballots are still uncounted.

But whether or not it's found that Hoffman received more votes than Owens, will it actually matter, given the hard-fought precedent that Republicans established in 2006 in a very similar election?...

1. Thanks Brad.
When someone concedes, isn't that normally when a race is declared over? I'm not saying it should be but was wondering. And yes, Republicans can't complain should a later count reveal something different given the precedent lest they admit the past in an official news conference.

7. Concessions...
"When someone concedes, isn't that normally when a race is declared over?"

A candidate concession has nothing, legally, to do with the results of a race. The media and public tend to declare a race "over" when there is a concession (just one of the reasons we've been trying to encourage candidates to NOT concede until all votes are counted, and counted accurately and transparently), but that doesn't mean it's actually over.

A concession is a nicety, but it has no actual legal meaning.

5. The last I heard
Owens went from about 5 thousand to 3 thousand. Now in my book that is still a winner. And one of the republicans in New York said that it was enough of a total count to be declared the winner. In other words Owens won no matter how small.

8. Well, you haven't checked lately...
There are still some 10,000 absentee ballots out there, uncounted. And military ballots are still coming in, legally allowable until next Monday to come in.

There's a 3,000 vote margin now, but lots of absentees still to be counted. Is a tough hill to climb for Hoffman, but could still be done. Read the link in the original article.

6. PS the republicans said when bush stole the white house
that regardless of whether the final tally gave Gore Florida bush was sworn in and that is all that mattered. Same thing with Owens.
