Capt. Connie Rhodes asks for Judge Clay Land to reconsider; attorney Orly Taitz involved

Army Capt. Connie Rhodes, who unsuccessfully petitioned a federal court to stop her deployment to Iraq by arguing President Barack Obama cant legitimately hold the office, has asked U.S. District Court Judge Clay Land to reconsider his Wednesday ruling.

The emergency request for stay of deployment and request to amend the judgement was filed Thursday on behalf of Rhodes by attorney Orly Taitz a national figure in the birther movement.

In her Sept. 4 complaint, Rhodes argued that some facts point to Obama not being naturalized or possibly an illegal immigrant. She said she couldnt be lawfully compelled to obey a de facto presidents orders.

In a Wednesday order Taitz called sarcastic and biting, Land denied Rhodes request and told Taitz she would face sanctions if she ever again filed in his court a similar frivolous action.

Plaintiff avers that there is increasing evidence that the United State District Courts in the 11th Circuit are subject to the same illegitimate chain of command which plaintiff has previously protested in this case... Rhodes Thursday filing states.

Rhodes claims in her Thursday filing that Land denied her Fifth Amendment right to due process of law by not letting her file a response to the governments motion to dismiss. Also, Rhodes had no meaningful access to the courts because Lands ruling didnt address any of her arguments, the request states.

In his ruling, Land said Rhodes had no credible evidence and made no reliable factual allegations that would support her unsubstantiated claims that Obama cant serve as president. Instead, Rhodes used her complaint for political rhetoric and to call Obama an illegal usurper and unlawful pretender, the judge writes.

She's deserving of the Number.

Reassignment to Fort Not the End of the Earth, But You can see It from Here. Nearest US civil court is on the other side of the planet. One med off slot, so she's on her own with all the bs that comes with it -- mainly paper work. "Ma'am, a request for band aids requires DD Forms 1234, 666, 9999 in trip by commander, pending approval from Hq." (which BTW is also on the other side of the planet). She'll have one, maybe two, corpsmen -- SSgt Figmo (fuck it, got my orders) and Pvt Slackass who hasn't broken a sweat since basic. Word was sent ahead of her that she's an asshole and troublemaker so it's a career killer if you sign up for her fan club. If she's boozing at the O Club, she's by herself. At the mess she alwasys has a table to herself. Official word is she's billeted by herself because she's a med off -- official word that is.

12 months of the Number either brings Fuckup to Jesus or s/he puts in resignation.

She was asked if she'd deploy if told by GW Bush and said yes. Asked if she'd deploy if ordered by McCain, she said she'd go...

I'll be happy when she is either in Iraq or a jail cell.

How not to win an argument.

You can tell a judge they are mistaken about the law or misinformed about the facts. You cannot tell them they're crooked.

They'll both be sanctioned for this. It may just be a scolding, but I suspect they'll pay costs and maybe some attorneys fees.

when she decided that becoming a part of a crackpot case being run by a crackpot 'lawyer'. She couldn't have chosen to put an end to whatever will be left of her military career in a more spectacular fashion.

If there is ANY justice left in this world, she will, at an absolute minimum, be on the hook for the last 2 years of med school that we paid for.

if she will refuse to go. I think that will depend on if she believes the military will either (a) give her a dishonorable discharge only......or (b) subject her to jail time. If its only the discharge, I think she would opt for that. If its jail, I think she would rather be deployed. Im merely speculating. I have not spoke to her regarding this. But, I know her well.

First, she's not the first military person who is not keen serving in Iraq and/or Afghanistan. Let's face it, not the safest place to be right now. There were thousands of people in the military not keen on heading over there and that started way back in the Bush administration.

So she doesn't want to go to Iraq, the line forms to the left for that group. But working with this hack who got her law school degree from a mail order catalog is probably the most stupid thing one could do. And from what I can tell this military Captain is just shooting herself in the foot.

They charge right back in and double the bet. By claiming the judge...and apparently the entire 11th Circuit, along with the military chain of command...are somehow illegitimate.

Jebus. Have they started screaming about "admiralty flags in the courtroom" yet? That was popular back in the 90's, when crackpot militias were challenging Federal authority.
