Forced Catheterization Used In DUI Case

LAWRENCEBURG, Ind. -- An Indiana man has filed a lawsuit claiming that police forcibly withdrew blood and urine from his body during a drunken driving arrest, WLWT-TV reported.

According to the suit, police arrested Jamie Lockard, 53, on suspicion of drunken driving in March.

A Breathalyzer test showed he was under the legal limit, but Officer Brian Miller doubted the findings....

5. Srupid cop
this couldn't have been used as evidence and besides that the blood test proved the breathalyzer results. What I want to know..."who did the catheterization?" Did some health care worker participate? He/she should also be charged with assault.

6. any lawyers in the house today? I always read that permission for tests was implicit
when applying for drivers license in all the states I have lived in.

8. I really object to the fact that the cop charged him with obstructing
a police officer after the blood test as well as the breath test showed he was not over the alcohol limit.

Obviously, that cop was out to get him for whatever personal reason. I hope he sues everyone involved, and I hope that cop loses his job.
