Many of you likely have no idea who this is or maybe a vague idea if you have followed the Duke Rape case. Mr. Elmostafa was the cab driver who drove Mr Seigleman to the ATM machine. When he had the audacity to truthfully back up Seigleman's alibi, he got arrested on a two year old misdemeanor warrent. He was eventually tried and acquitted. Like any out of control prosecutor Nifong went after any and all people who stood between him and a conviction. Mr. Elmostafa is a poor immigrant. No high powered defense or access to bail for him. Thankfully it worked out for him. But how many facing a prosecution and possible deportation upon conviction would have done the easy thing? That is what proseuctors count on. In some, probably even most, cases it provides truthful or at least mostly trustful testimony. Prosecutors without morals or control should be everyone's nightmare. Anyone of us could be an innocent witness in the way of some rogue prosecutor jonesing for a conviction. Would your life stand the scrutiny of a tin horn Ken Starr? Are you gay in an occupation where that could get you fired? Have you not paid a bill on time? Do you have a pissed of ex? Owe any taxes? Take any dubious deductions? The list goes on and on. Virtually anyone can be caught in the vice of a despotic prosecutor. Just ask any of the anonymous victims of Starr? Mr. Elmostafa deserves kudos.
