He said yes to speaking with Congress, he said he'd have to see what precedent it set re: doing it under oath.

22. That wouldn't have made sense to say no, then leave the option open.
For accuracy's sake, Cheney said he would go to Congress (meaning talk to individual members), but when Schieffer asked him about testifying under oath, that's when he said he would have to look at the precedent it would be setting.

Now, of course, that's a dodgy answer, no doubt about it, and it would probably mean he would resist, but I'm just urging accuracy when reporting on something that others are not currently watching.
