Fight over White House subpoenas heads to court

Mon Jun 23, 6:04 AM ET

WASHINGTON - Lawyers for the White House and Congress are headed to court Monday in a dispute over whether top aides to President Bush must provide evidence in a House investigation.

The Democratic-led House Judiciary Committee is demanding documents and testimony from the president's chief of staff and former lawyer about the firing of federal prosecutors.

The White House says Congress can't do that because of the separation-of-powers doctrine.

A federal judge has scheduled a hearing for 10 a.m.

The Bush administration wants the court to stay out of this fight, but lawmakers say the court is obligated to help enforce a congressional subpoena.

4. "Hiding" as in covering their asses. Agree that they're stalling for time.
Still, what makes them think the quest for justice will end anytime soon?

On July 19, 2007, he dismissed a lawsuit filed by Valerie Plame Wilson and her husband against Vice President Dick Cheney, White House political adviser Karl Rove, former White House aide I. Lewis "Scooter" Libby and former Deputy Secretary of State Richard Armitage.

In a December 30, 2002 decision, Judge John Bates of the U.S. District Court ruled that lead plaintiff Representative Dennis Kucinich and 31 other Members of the House of Representatives have no standing to challenge President Bush’s withdrawal from the Anti-Ballistic Missile (ABM) Treaty without congressional approval. He also ruled that the case presents a “political question” not suitable for resolution by the courts."
