...I used the term murder only because Mr. Bugliosi chose to.

3. Yes and no.
If he stood trial, it would serve as a negative precedent in terms of exercising the powers of the executive branch.

If your goal is to accrue even more power to the executive branch, then a former head of that branch standing trial for war crimes or crimes against humanity would decidedly be a bad thing for you because now your power is limited post-trials.
