A Penn State college senior was arrested after he pointed his camera cell phone at police activity in his neighborhood. A Philadelphia NBC News Channel 10 report says the family of Neftaly Cruz, 21, is claiming the cops had "no right to come onto their property and arrest their 21-year-old son simply because he was using his cell phone's camera."

Cruz had heard a commotion outside his parents' home and walked out the door to investigate it. When he saw the street lined with police, he flipped his phone open to take a picture. Within moments, an officer came to his back gate, put him into a police car, cuffed him and took him to jail. According to a neighbor's report, the cop spoke only once during this process, allegedly saying, "You should have just went in the house and minded your own business instead of trying to take pictures off your picture phone."

The charge against Cruz was based on a new law, allegedly prohibiting people from taking pictures of police officers with cell phones. Cruz is quoted as saying, "They threatened to charge me with conspiracy, impeding an investigation, obstruction of a investigation..." Larry Frankel of the local ACLU chapter, reportedly said, "There is no law that prevents people from taking pictures of what anybody can see on the street," adding that, "it's rather scary that in this country you could actually be taken down to police headquarters for taking a picture on your cell phone of activities that are clearly visible on the street." - ST

"There is no law that prevents people from taking pictures of what anybody can see on the street," said Larry Frankel of the American Civil Liberties Union. Frankel said Cruz's civil rights might have been violated.


"He was unlawfully seized, which is a violation of the 4th amendment the last time we checked," Frankel said.

The story said based on a new law (though I don't see how or have heard of such) and that was the reason for my response. They all seem to make up things as they go along these days. Hope the courts set them straight and start punishing police officials engaged in false arrests.

47. Absolutely right on. Precedent, unless it changed, allows for taking
pictures anywhere considered "public". Even the inside your home is considered a "public" space that can be photographed, but only through windows or doors, if the blinds/doors are open. From what the ACLU rep said, it doesn't sound like that precedent has been revisited. Yet...

i am not going to join the crowds yelping "keep us posted," it may well be that you have knocked out one of your most powerful negotiating tools by publicizing this arrest before you have had an attorney look at all your options

of course miami may be less corrupt than some other areas of usa, but i do know of a case similar to this where the innocent victim of police brutality could ultimately only get the very serious "resisting arrest" charges dropped against her by dropping her own lawsuit and any publicity against the police department in question

if the case already becomes well-publicized, you've lost that bargaining chip and you may actually give the police/prosecutors more motivation to bring a strong case to try to convict you -- reason, if you're convicted of these charges, you won't have as much luck suing them for the brutality

this is just my opinion and not a true legal opinion but it's a concern i've had since reading your first post on the subject (i hope an unnnecessary concern but the point is I DON'T KNOW)

i think you need an attorney NOW who has experience dealing with this type of case

it could very well be the attorney will advise you to stop publishing or posting about it on the internet or in the other news media until they have a better idea of where the case is going

keep in mind, police depts. don't like to pay out big settlements, as far as they are concerned, it's better for them to all hang together and convict you and destroy your life if this thing can't be quietly dropped

you need better advisors than the internet

crimes are too often hidden from view? RagingInMiami is an activist and he knows these things need to be publicized. We all know that the police will get away with these kinds of fascist tactics because hardly anyone makes their behavior an issue.

If the ACLU takes the case I think he has a good shot.

Can't help wondering what RagingInMiami's appearance and clothing were during the police incident. The photo in the Category 305 article (link below) may have conjured up paramilitary images that police and the establishment automatically react to as worthy of suspicion and harassment. Am speaking of RagingInMiami's photo in dark glasses, military fatigues, and sho-boy/military inner-city hat -- etc.

The police seem to have knee-jerk reactions to certain clothing. So much of what we're seeing seems to be a class issue. If he was dressed in a suit, standing next to his Mercedes, he would most likely have been treated much differently.

i think he needs to talk to a lawyer and figure out how to keep his ass out of prison

better than drawing attention to injustice is to stop the injustice cold

my concern is -- by publicizing too aggressively without legal advice, it could be he's giving away one of the chips he may need to survive, people sitting here and cheering him on and crying "lawsuit" may be urging him to do the one thing that will cause the miami pd and district attorney's office to band together and be sure he is tried and jailed so that no civil lawsuit will stand a chance in front of a jury

and don't say it can't happen, innocent people go to jail all the time, dna proves it these days

now if his attorney has already signed off on the publicity, that's a different matter, i'm sure he or she knows best the strategy for that area

but i'm not going to sit here at no risk to myself and urge someone to continue on a highly risky path to them

hell, i may worry too much and the police brutality case i discussed in the post above is old -- but still -- it's best to consult w. real legal experts before publicizing things like this

To begin with -- what he did is not against the law.

The police officers violated the law.

RagingInMiami has a damning photo.

The photographer is NOT in jail.... it's a little too late for them to arrest him again because he did not violate the law.

The story the cops told has already been recorded -- part of their testimony is already provably false.

This police incident is one of many where the Miami PD is completely out of line. RagingInMiami is fighting injustice. He is a kind of hero for doing this. Don't ya think?

36. your story has become a big topic of conversation (central florida)
i'm in central florida -- brevard, palm bay, melbourne -- and when i read your first piece i brought it up for discussion with friends. we "get it" about hyper cops. most of us have spent some time in miami -- it's not Nashville. there's some real tension.

i used to publish to newspaper, so i was arguing the point that journalists NEED to be out documenting street scenes -- like Weegee. and i wondered if he ever ran into a situation like yours.

my friends were quick to point out that cops have a "prey instinct" now -- espeically in tense areas -- that makes getting near them really dangerous. i understand what they are saying from a personal standpoint... you don't people close to you to be in danger... and that's how the conversation evolved.

my point is, there's a theme (or a story) here about the journalist's role in crime and city reporting that people JUST DON'T GET anymore and it's a shame because we need you guys now more than ever. cops are too accustomed to operating in "the dark." civilians are too accustomed to fearfully avoiding cops and victim-blaming when something goes wrong.

my heart says that there's an action beyond the court action -- maybe this is something that is taken to the Metro Board and argued from the standpoint of "hey -- we are SUPPOSED to be on the same side here, are we not?" yes, there needs to be justice, absolutely. but i'd also like to see you be able to use this incident as a means to gain access and dig deeper into your field. cops need to know who the "good guys" are -- and even if in your heart of hearts you fear and loathe these fuckers, your best interest lays in them recognizing you as a VALID and IMPORTANT part of the city just like them -- like you said -- we are all blue collar workers here.

best of luck -- and i am so sorry this happened. i was beat up once by a "peace officer" -- i know the "crazy-making" world that lands you in. i like the story your editor wrote -- keep keeping on.

This very issue was settled in the Florida Supreme Court which established that the police CANNOT order you to stop taking pictures or to leave the area while they are doing police work UNLESS you have crossed over the yellow tape at a crime scene. There is a law against doing audio tapes of police activity -- but not video, and not photographs.

Look it up yourself on Nexus Lexus in Florida case law, or call any photographer at a news agency in Florida. To be sure nothing has changed I checked with a friend who has been a Florida police chief for many years, and with a local criminal attorney. The photographer is in the right. The Miami PD is in the wrong. The photographer has the right to sue.

everywhere I go and won't hesitate to use it to take pictures of any police activity that looks the least bit suspicious.

I've used it to take pictures of the cops at demonstrations but in San Francisco most of the cops are on our side anyway.

That wasn't the case back in the 60s--I got rousted plenty in S.F. back then...

While reporting about Miami's Upper Eastside gentrification efforts for the online publication Category305, Miller began photographing some Miami police officers interviewing a subject on Biscayne Boulevard.

According to Miller's account of the story (read what Category 305 posted), five cops asked him to move on. He says he identified himself as a journalist and informed them he was allowed to photograph on public property.

They disagreed, saying Miller was standing in the middle of the street and disobeying their orders. He was arrested, charged with several misdemeanors and booked into jail, where he was released the next day pending trial.

Miller pleaded not guilty and says he will fight the charges. In an e-mail to me tonight, he wrote, "Sure it would have been easier to do as they say and continue walking. But for me, it's more important to stand up for my First Amendment rights. And this, as you know, affects all of us in the media."

Since you first posted, Raging, I had a minor problem with a State Trooper.

A few days ago I was traveling home, finishing a 340 mile round trip, and was almost to my interstate exit. I was tired--I had driven the whole trip, it was 1:15am, and I had increased my speed way too much. (I have to say that I am an excellent driver, never had an accident, and never had an insurance claim, but I do have a heavy foot at times.) Driving down a long slope, I spied a trooper's car hidden in trees in the median and as soon as I spotted him, I hit my brakes and slowed down. He pulled in behind me and followed me for at least a half mile before turning on his blue lights.

I pulled over, rolled down my window, and exercised my most polite voice. I did not protest the ticket in the lest---until he said that I had continued to travel at my clocked speed of 79mph! Horseshit! (I didn't say that out-loud.) I had dropped below 65mph very quickly! My hubby verified that, but, still, I only said, "I don't think so"!! There was no other conversation as I thought it best to save it for court.

When he handed me the ticket, I said "thank you," which was just a conditioned response for this southern gal---when anyone gives me anything, I say 'thank you.' It was then he wheeled back toward my rolled down window and loudly and sarcastically said, 'WHAT did you say to me?"
I repeated "thank you!" I wanted no other conversation with this little lying bastard---I say 'little' 'cause he was shorter than 5'5" me!

On the drive home, I kept puzzling and asking my hubby what the hell did this "officer" think I said?? After a few mins. it dawned on my hubby that this 'officer' thought I said 'Fuck You'!!!! As if I'd be stupid enough to say that to an officer!!! And as if I'd be stupid enough not to slow down when a state trooper is following me!!!

By the time I got home I was more than furious. At 1:30am I called the State Trooper offices in the capitol to complain about this jerk, and after unloading to three people, I felt better. I intend to write a letter that I'll read to the judge when I go to trial in March. I don't expect much, but I'd like to embarrass this "officer" in court. I should offer to take a lie-detector test (yes, a bit overly dramatic, I know) if that bastard will. Y'all think?

My little story is very trivial, and I tell it only because I've never had an officer treat me like that ever before and because I immediately thought of your awful experience, Raging. How outraged you must have felt!!

I realize that most officers are good folks trying to make an honest living protecting society but some are very insecure and some are just down and dirty rotten bastards.

Larry Frankel of the local ACLU chapter, reportedly said, "There is no law that prevents people from taking pictures of what anybody can see on the street," adding that, "it's rather scary that in this country you could actually be taken down to police headquarters for taking a picture on your cell phone of activities that are clearly visible on the street."


Let me get this straight...the government and corporations can put cameras on every traffic light and building, watching our every move, but we ordinary citizens can't photograph jack shit?

74. The answer is remote-feed video.
All people need to do is walk around with those all day.

They can take the camera, but unless you tell them where the receiver is, they can't take the footage away and it can be used as evidence later.

I am all for civilians performing surveillance activities. The cops hate the idea because they might have to stop acting like assholes.

Why are these assholes so conditioned to treat everyone like criminals?

I don't know what the name of the equipment is, I just know that we should have some sort of hand-held video device that feeds a transmission to a remote recorder.

Sure, the technology is already in use, but the application of an AV feed when asshole cops are about to fuck with you is priceless.

So you've got your little camera, they walk up and ask what you're doing. You say, "Just taking pictures of the skyline". They say 'give us the camera'. You say, "Well, no. Besides... it's on remote feed so it's actually recording all this somewhere else."

"What the $#^&? Give me the camera!"

"Sir, I'm just taking a video of a public street, and the footage is being sent somewhere very safe. Thank you for your concern, I can assure you I'll be done in a few minutes."

-Get the idea?

If the cops know that what they are doing is on a video they can't get a hold of, they are much more likely not to be assholes.

They could beat me to death before I told them where the storage device was, then my wife and my attorney would make a fortune and the assholes could go spend time in jail with the convicts they fucked with.
At least that way the police would have to become more and more conscious of their behavior.

It's a win for Civil Liberties.

80. "Resisting Arrest" is such a bogus charge.
The Police don't say what a person is being arrested for when they start their physical abuse. When a person asks questions about what is going on that is declared "Resisting Arrest". The Cops in this case need to be charged with Abuse and fired.

It was in the comments section of the Miami Herald site. I didn't know we were all a bunch of treasonous weirdos investigated by the Secret Service!


"This article is about a known traitor who is from Democrat Underground, a treasonous site that has been investigated by the Secret Service and the FBI for threats against the national leaders. The Miami Herald has been notified that they are attempting to make false charges against the Miami Police.

Obviously the cops felt that they needed to control the small area around them while they were doing their investigation. They had no idea who this traitor really was and therefore could not determine if he was a threat to them or not. Better safe than sorry.

These same traitors will call a cop at the first sight of any political confrontation in the street too.
