ALAN HEVESI MUG SHOT AFTER PLEADING GUILTY FOR HAVING WIFE DRIVEN BY STATE SECURITY WORKERSHere is the law. Since Giuliani misappropriated more than a thousand dollars for his own personal use, he apparently violated this NY State Penal Code S 195.20, a Class E Felony:
S 195.20 Defrauding the government.
A person is guilty of defrauding the government when, being a public
servant or party officer, he:
(a) engages in a scheme constituting a systematic ongoing course of
conduct with intent to defraud the state or a political subdivision of the
state or a governmental instrumentality within the state or to obtain
property from the state or a political subdivision of the state or a
governmental instrumentality within the state by false or fraudulent
pretenses, representations or promises and
(b) so obtains property with a value in excess of one thousand dollars
from such state, political subdivision or governmental instrumentality.
Defrauding the government is a class E felony.
Giuliani broke the same law as Hevesi by having the NYPD chauffer Nathan around. He also had his other mistress Christyne Lategano picked up by the NYPD for THOSE trysts. It is a Class E felony and because it is being denied by Giuliani, who has changed his story 7 times now on the other billing fraudulent billing, and because it is all so similar to Kerik's case, s prosecutor would have a field day in court on this case.
Alan Hevesi pleaded guilty this morning to one count of defrauding the government, a Class E felony, and resigned his post, marking the end a four-month scandal that brought down one of the state’s top elected officials.
Hevesi was booked, fingerprinted and released on his own recognizance. He is due back Feb. 9 for sentencing. He must pay a $5,000 fine in addition to the more than $200,000 restitution he has already paid.
He also agreed to resign from his post effective immediately, and resign from his new term, to which he was re-elected with 57 percent this November, effective 12:01 a.m. Jan. 1, 2007.
Appearing before Albany County Judge Stephen W. Herrick, Hevesi, 66, a Democrat whose job was to be the top watchdog over state agencies, admitted he had state security workers drive his wife and attend to her personal needs, and that he didn’t intend to pay for it. He said there were security concerns for Carol Hevesi, but the work of these taxpayer-funded employees went beyond that.
“I apologize to the court,” he said. “Before this issue became a public matter, I did not plan to reimburse the state…I plead guilty, sir.”

Albany County District Attorney David Soares said he insisted on a felony charge in light of the extensive personal service Aquafredda provided to Carol Hevesi.
“It was important to us that it was a felony plea,” said Soares.
