Arraignment for Donkers reset Mom got national attention for breastfeeding on highway
An arraignment scheduled in a Portage County court today for the woman who gained national attention in 2003 for nursing her infant daughter while driving on the Ohio Turnpike has been reset, according to Portage County Prosecutor Victor Vigluicci

Earlier this year, Donkers' 2003 conviction on a charge of violating Ohio's child restraint law was voided by the Seventh District Court of Appeals in Youngstown. Donkers had argued since her vehicle was registered in Michigan, where she lived at the time, she only was required to adhere to Michigan's child restraint law and not Ohio's.

The court also modified Donkers' conviction on driving without a license from a first-degree misdemeanor to a minor misdemeanor because of insufficient evidence that her Michigan license had been expired for more than six months. That charge and another first-degree misdemeanor charge of failure to comply were remanded by the court for a new arraignment.

During her three day trial in Portage County Municipal Court in August 2003, Donkers acted as her own attorney and admitted not only to breastfeeding her then seven-month old daughter Seren but also to talking on a cell phone, writing notes and watching as Trooper Adam Doles chased her for three miles before she finally stopped at the Streetsboro toll plaza.

Donkers and her partner, Brad Barnhill, had said at the time they are members of a group known as First Christian Fellowship of Eternal Sovereignty and as such, Barnhill was the only one who could punish Donkers under the law of "coverture."

she was driving in ohio but argued that she shouldn't have to follow ohio law because her car was not registered in ohio?

:wtf:

does that mean i can violate wyoming traffic laws because my car is registered in colorado?

5. The way the article is written makes it sound as though the court actually
agreed with that argument (bad writing I'm sure, not bad judging). However, I'll try to get one of my stupider and more expendable friends to test this legal theory next time we're out of state... :rofl:

8. i was thinking that as well...
your honor, under the precendent set in ohio v donkers, you only have to obey the traffic laws of the state in which your vehicle is registered...
