Schumer said his “greatest regret” in the last Congress was not doing more to scuttle Alito.

New York Sen. Charles E. Schumer, a powerful member of the Democratic leadership, said Friday the Senate should not confirm another U.S. Supreme Court nominee under President Bush “except in extraordinary circumstances.”

“We should reverse the presumption of confirmation,” Schumer told the American Constitution Society convention in Washington. “The Supreme Court is dangerously out of balance. We cannot afford to see Justice Stevens replaced by another Roberts, or Justice Ginsburg by another Alito.”...

Senators were too quick to accept the nominees’ word that they would respect legal precedents, and “too easily impressed with the charm of Roberts and the erudition of Alito,” Schumer said.

“There is no doubt that we were hoodwinked,” said Schumer, who sits on the Senate Judiciary Committee and heads the Democratic Senatorial Campaign Committee....

Schumer voted against confirming Roberts and Alito. “In Friday’s speech, he said his “greatest regret” in the last Congress was not doing more to scuttle Alito.

"Alito shouldn’t have been confirmed,” Schumer said. “I should have done a better job. My colleagues said we didn’t have the votes, but I think we should have twisted more arms and done more.”...

4. I am starting to think that when the Dems win a comfortable majority in '08 (hopefully)
....they should simply add two more Supreme justices to the court, for a total of 9. This can be done by Congress with a simple majority vote and would be a lot easier than trying to impeach a Supreme Court justice.

37. LOL. Should have cut the vicodin in half. I meant a 7-4 or 6-5 court
instead of the 5-4 lockdown we have now. That would make a total of 11. I think.

19. Scalia is vulnerable for refusing to recuse himself from Cheney's case
Even though he pals around with the mad shooter on hunting and fishing trips and such.

Hell, because he goes on hunting trips with Cheney, we should have him removed because he is mentally unstable.

Though the hoodwinking came via a good dose of self-delusion.

I think a fair number of too-long-in-Washington Dems convinced themselves that if they went along, once they had regained Congress, Bush and the Republicans would recognize which way the winds were blowing, and be cooperative towards the Democrats.

Utterly delusional of course. And I would not be surprised to learn that the Republicans led them on in this delusion. Nonetheless, it's at least 50% self-delusional.

Schumer was ready to back an independent campaign for Joe Lieberman versus Democratic nominee Ned Lamont before the DSCC pulled him back into the fold. If Schumer were to be replaced by another Democrat with more common sense, I wouldn't shed a tear.

Add them after Bush leaves, of course- but add them. I don't want to hear anything about being "hoodwinked". For crying out loud, I'm just a working stiff and I knew what those men were all about. Surely the Senate knew. They chose not fight, for whatever reason-- they were NOT "hoodwinked".
