3. Hope
Here is Lazer47's post:

The Judge did not dismiss it with prejudice which means

it can be re-filed, he only dismissed it over jurisdiction, and it also can be appealed.

4. They can refile
in a different court, but that court may say the same thing.

5. The answer is yes
However, with SCOTUS dominated by right wing ideologues, it would be an exercise in futility.

10. Yeah it must be my 13th generational maternal gene pool rumbling
at a slow boil for far too long.

I just find total impunity for trason somewhat annoying and really used to like the rule of law.

I'm such a sentimentalist.

11. It is a sad day
when an administration lap dog can deny not only the Wilsons' their day in court, but the American public the opportunity to have the role of the OVP/WHIG/OSP exposed in a way that allows them to understand how we ended up in Iraq.

You know as well as I know this is unsustainable.

Though it sounds naive, the pendulum always swings the other way.

The Wison's are too honest and true to take this lying down.

It's such BS and there has been so much positive momentum over the past few weeks. . .feel the watershed. . .though we've hoped for this for a long time. . .it feels as though the tide is turning at long last.

17. I think that
Bates is the type of republican lap dog that many here on DU had feared that Reggie Walton might be. Today's decision is not unexpected, and Bates' attempt to sidestep some issues may provide more solid footing for the Wilsons' legal team. More, I think it shows the absolute need for a serious congressional investigation into the activities of the OVP/WHIG/OSP.

9. check this bullshit out:
"U.S. District Judge John D. Bates said that Cheney and White House aides cannot be held liable for the disclosure of information about Plame in the summer of 2003 while they were trying to rebut criticism of the administration's war efforts levied by her husband, former ambassador Joseph C. Wilson IV. The judge said such efforts were certainly part of the officials' scope of normal duties.

""The alleged tortious conduct, namely the disclosure of Mrs. Wilson's status as a covert operative, was incidental to the kind of conduct that defendants were employed to perform," Bates wrote in an opinion released this afternoon.
