Prosecutor says Libby destroyed Cheney memo
WASHINGTON - Special Prosecutor Patrick Fitzgerald used his opening statement in the CIA leak trial Tuesday to allege that Vice President Dick Cheney's chief of staff lied and destroyed a note showing Cheney's early involvement.

2. HOLY CRAP! Why isn't Cheney being charged with obstruction of justice?

That's like the gap on the Watergate tapes.

3. It still has to be proved and they need evidence.
You can't bring a case against a vice president without real facts.

6. They would have to prove he told them to destroy it
But, yea, I agree that it doesn't seem to matter what Bush/Cheney have done. There seems to be no consequences for their crimes. NONE!!!

31. Couldn't Fitz lean on Scooter to get him to reveal evidence against Cheney?
Edited on Tue Jan-23-07 02:52 PM by meldroc
Offer a plea bargain - shave a couple years off his sentence if he testifies against Cheney or points Fitzgerald towards evidence implicating Cheney?

Chances are this is exactly what happened. He offered a sentencing deal, Scooter gave some juicy information, Fitzgerald followed some bread crumbs and found a smoking gun with Cheney's prints on it.

9. because he leaked the name
libby trashed the note and lied....the leak law is written so that you have prove intent...its like impossible to get a conviction. Had Libby not lied...it seems nobody would be in court right now.

14. Libby's perjury and obstruction of justice prevents Cheney being charged
Edited on Tue Jan-23-07 12:33 PM by Kagemusha
by obscuring the evidence that would otherwise be used to charge him with.

Get it?

Edit: That's if Cheney gave instructions to do this. Libby's such a good soldier, he might not have needed to be told.

I would hope there will be other charges and other perps brought before the courts before this is all over.

23. This must be the dirt kicked in the umpire's eyes that Fitzgerald referred to
and that has kept him from getting the full story and the real perps.

15. Well now I understand Fitz' whole thing about that.
The obstruction of justice is not the product of perjury. The perjury is the means by which justice was obstructed, and cannot logically exist without the intent to obstruct justice.

Libby's lawyer was apparently arguing that Libby would never have lied because there was no underlying crime.

But obstruction of justice IS the underlying crime. That's the logic contained within "the four corners of the indictment". And a damning indictment it is.

Cheney wanted to discredit Wilson so he told Scooter to blow Plames cover. Now Scooter takes the fall for the coverup.

With Fitz pointing his J'accuse finger across the courtroom
as guilt drops crushingly upon mean old man Cheney?

Or will it be more of a Scooby Doo moment?
