Virtual Bank in Palm Beach Gardens, Florida brought a foreclosure action against a homeowner and was unable to prove that it owned the mortgage. The court awarded the homeowner's attorney his legal fees. After months of inability to collect the award from the bank, the homeowner's attorney received an order from the Court to seize the banks property including money from the tills and ATM machines.

The Sheriff arrived on the scene as well as police in full tactical gear. They entered the bank. It is believed that at the last minute, the bank wrote a check for over $30,000 which they offered to the Sheriff rather than face the loss of their property.

would have been far better than the video. We saw the cars pull up and go into the building and then come out. Not much else. Mostly the camera man hanging around outside the building taking shots. I would have thought there would be more to the video by itself however, it didn't show that much. Kind of disappointing that we never even saw the owners of the bank or anyone of official capacity.. sorry just my two cents.

Surprise. The law actually applies to them. There were professional news crews on the scene but I haven't yet seen any reports they might have produced. At least there is this footage taken by the foreclosure activists in Florida. The Sheriff didn't appear to welcome any onlookers inside the building.

I'm happy that a Florida court actually required a bank to prove ownership of a mortgage instead of just rubber stamping the foreclosure as often happens in Florida. I'm also happy that the court enabled the attorney to seize property and that the Sheriff acted upon the court's order. If you are familiar with foreclosures in Florida at all, this is actually a somewhat rare occasion when government functioned properly in this foreclosure mess.

Hopefully, next time that bank will be a bit more careful when it brings a foreclosure action against a homeowner.
