There is now 3 rulings saying the health care law is constitutional and 2 rulings saying it is unconstitutional. This is clearly going to the Supreme Court, as a result. In the worst case scenario of Section 1501 being held unconstitutional, this would only strengthen the public option, as discussed in this video. In this case, the kicker is whether Democrats will be able to pass the public option. This means a strong Democratic turnout in 2012 would be a necessity for the existence of the health care law.
Still, the Commerce Clause gives Congress broad authority, so Section 1501 will likely be upheld when it reaches the Supreme Court. Otherwise, other cases depending on the rationale of the Commerce Clause would also be put in to jeopardy.
