19 out of 30 private sellers sold guns to investigators who said they probably couldn't pass a background check.

7. The DC sniper bought that gun under the table at a licensed gun shop.
Bull's Eye Shooters Supply in Tacoma washington. The seller was required under federal law to perform a background check. The seller did not. The seller, when investigated by the BATFE and FBI, had apparently 'lost' around 300 firearms, including the Bushmaster AR-15 used by the DC Sniper.

That weapon was not sold at a gun show. Our gun shows, in Washington State do not have this problem. All Washington Firearms Collectors shows REQUIRE buyers and sellers to be members. Membership requires either a valid concealed weapons permit, or a NICS check. Anyone buying or selling at the show, that is not a member, is escorted out.

Other states, mileage may vary.

Side point, the 30% connected to gun shows statistic thrown out in that video does not preclude straw purchases. The US Department of Justice did a survey of convicted criminals, and most got their guns on the street or from a family member. .3% came from gun shows. Which jives with my experience at the WAC shows in washington, where you can expect about every 5th buyer or seller you bump into is a retired, off duty, or on duty police officer. Criminals do not frequent places that are literally crawling with police, and the local police make a strong presence felt at the shows.

On top of that, private sellers have no way to verify the true background of the buyer aside form the buyer's word.
Unless the seller KNOWS the buyer is ineligible to own a firearm, it's not a crime to sell it.

As a gun owner, I support opening up the NICS checks for private sellers' use.
This would be an added assurance a law abiding seller could vreify the buyer was lawful as well.

4. Most of the pro-gun people who post here support opening the NICS...
to private sales. Further, if some guy is making a business of buying and selling guns, then the BATFE says that he needs an FFL. If he doesn't have one, he is selling illegally, and needs to be arrested.

8. By all means, open NICS to private sellers. And that 'private seller' that sold 300+ rifles is fucke
d when the BATFE sees this. You can only sell so many firearms per month and consider yourself a private seller. I forget the limit, 2 or 5 or so, but that guy is WAAAAY over the limit.


I own firearms. I suppport the 2nd Amendment. I am all for giving private sellers a tool, like access to NICS, to prevent this issue. If not NICS, require all sales to go through an FFL 3rd party, and fund those FFL transfers with an ammo tax or some other federal funding.

Plus this is a NYC investigation. The most stringent gun laws in the nation, yet some of the most vicious gun crimes-usually by cops who mistake wallets for guns.

10. Closing the loophole won't stop the sales - like Canadian pharmacy sales don't stop

Maybe we should simply issue a gun to every citizen on their 12th birthday - you get to pick what kind you get up to a certain value or you can add your own $$$ to get an upgrade. Everyone in America will be armed. And we'll go ahead and dump a truckload of arms at Home Depot parking lots so the illegals can have some too. Afterall, Reagan gave 'em Amnesty awhile ago so they are about due for another Republican Amnesty about now.

Everyone will be allowed concealed carry. Everyone will be well-armed. Heck, we probably won't even need the police any more so we'll save a lot of money in public services in that area.

What could possibly go wrong?
