How DARE she think she can rise above her place and take a place at the table with the Big Boys. Just because she's a House negro doesn't mean a damn thing. We let her in here, we can send her back to the fields with a snap of our fingers. Who has the power here? We do! I mean, HOW DARE SHE?

Different backgrounds and experiences have the ability to shape your personality, your actions, and even your place in life. Ever see a rich kid grow up to be a working class factory worker? But that doesn;t mean an irresponsible action can be excused away simply by claiming racial profiling. Labeling someone a racisty is a serious and damaging charge. If you assault someone and then claim in your defense that you were only stopped because you rare a certain color, creed, or sex, that still doesn't chang ethe fact that you assaulted someone. Whether this cop is a racist or not, she still didn't have her lapel ID pinned to her. It's his job to stop people without ID from using the congressional entrance.

Novel concept that the law is supposed to apply to everyone, isn't it? And I say supposed to because I certainly do not doubt that wealthier people (regardless of race) have access to better lawyers, and that poor people (regardless of race) do actually get screwed by the system all the time.

If you've seen my admittedly limited posts on this subject, you'll see that I've not condemned either party, except for one little issue. I worked in DC and have no doubt whatsoever that this Capitol Cop *should* have known who she was, as they are supposed to know the Congresscritters and Senators by sight. And that is the only condemnation I have posted. Otherwise, I don't know enough facts to defend or condemn either party.

20. Great - because of McKinney has been deemed guilty on DU,
then the officer certainly has as well.

In this case I certainly think far too little is known to determine that either is criminally wrong in some way.

But not a day doesn't go by that some Republican isn't deemed guilty here. And that's par for the course for message boards.

The presumption of innocence is a tremendously important judicial principle. But in fact, its application is intended for the courts, not personal speculation. If we couldn't BELIEVE someone is guilty, we'd never have any accused to stand trial.

30. Yes, but at the same time a conviction in the court of public opinion
can be just as damaging as a real conviction, a la Richard Jewel. Even the Eric Rudolph thing bothered me, especially when I heard otherwise good liberals saying things like "He wouldn't be running if he didn't do it." That's just crazy to me.

And really, the concept of presumed innocence means nothing if the court of public opinion doesn't follow that principle as well. How do we accomplish that, given our free press issues and the right of every individual to believe as they see fit? I don't know, except to gently remind people that the concept must be used in our personal lives if it is to mean anything within the court system.

People will always speculate and share opinions.

And I think you're dead wrong that the presumption of innocence is meaningless in the face of the court of public opinion. If it were so, we shuold just eliminate freedom of the press because the two would never reconcile.

We can all speculate - but I'll say that we should do our very best to limit factual statements to the known facts, and not confuse those facts with our feelings.

It seem to me they are getting more than the benefit of the doubt as it is. C'mon, Cheney can cuss in the Senate? He can shoot people?

Frist can engage in insider trading? Bush can lie us into a war and kill thousands? He can ignore Katrina victims and the press excuse it? He can crap on the Constitution - the LAW OF THE LAND - and get a free pass? Presumption of innocence, indeed!

As for the cop, he should be a well-trained individual who would not get in a scuffle like this with a Congressperson. If this isn't a setup, he's a bumbling idiot.

if for the only reason, if she is convicted of a felony, she will not get her pension. The pension for Reps/Senators is very good. I think it is their full salary even if they only serve for one term. Anyone out there know the rules?

of her integrity wouldn't be doing this just to be "stupid" and I choose not to judge her as "stupid" until I know the facts. To hold out her pension as a reason not to do something is stupid.

If a police officer harrasses me, touches me inappropriately, etc., I can see myself pushing him/her away. That could be construed as hitting a police officer, but would have simply been a common human protective impulse.

The point is that you don't know the facts around it.

"Witnesses say McKinney pulled her arm away, and with her cell phone in hand, punched the officer in the chest."

Doesn't say, everyone who saw it said this... and I highly doubt all "witnesses" who saw it said that she "punched" the officer. I believe this is a bit of creative license at work. If someone grabs my arm, my reaction might be to pull it away and make some sort of innocent swing with my other arm (that had a cell phone in it). Doesn't prove a thing to me.

The alleged quote from whoever wrote this (supposedly McKinney, though I doubt it) at the bottom of the article portrays a completely different story:

The writer details the incident, saying, "I was rushing to my meeting when a white police officer yelled to me. He approached me, bodyblocked me, physically touching me. I used my arm to get him off of me. I told him not to touch me several times. He asked for my ID and I showed it to him. He then let me go and I proceeded to my meeting and I assume that the Police Officer resumed his duties. I have counseled with the Sergeant-at-Arms and Acting Assistant Chief Thompson several times before and counseled with them again on today's incident. I offered also to counsel with the offending police officer."

So why jump to believing the officer and the so-called "witnesses" cited? Why not assume that we just don't know the facts yet?

on another site, it was stated that McKinney was "trouble" and that they had a picture of her due to that fact. She has done this before. My guess is that she was probably set up for this incident and she fell into the trap. Both parties ar to blame.

There is no evidence on tape that we know of at this time:

"A security video shows McKinney entering the building and moving around the metal detector and X-ray machine.

It does not show her encounter with the police officer, according to officials familiar with it."

It's also clear that we don't know all the facts as the "witnesses" have different stories (opinion) and the article makes clear that whether or not she "hit" him with her cell phone is up for debate.
