The Maryland State Board of Elections allowed Diebold Election Systems to operate its touch-screen voting machines during the state's 2002 gubernatorial election and the 2004 presidential primaries before the state agency actually certified the controversial machines, according to recently disclosed documents.

That is a violation of state law, according to Linda Schade, executive director of TrueVoteMD.org, an election integrity group.

Schade discovered the document among thousands of others she recently acquired through a lawsuit filed against the Maryland State Board of Elections in 2004. After almost two years of public records requests and attorney wrangling, she received four boxes filled with e-mail conversations, faxes and contracts between the elections office and Diebold.

"So far, we've only gone through one box and have just started the second box," she said Wednesday. "We expect to find much more."

My impression is that once an election is certified, that's it.

Just kidding. Seriously, it is unlikely that this has any implications now, as the election has already ben certified, and the office is up for election this year.

2. I often wondered how Erhlich got so many votes
Gov. Erhlich seemed to have an abnormally high vote in places where you wouldn't have imagined it. I don't think it was because he's from Baltimore's suburbs

8. In 2002, Governor Ehrlich became first repub gov. of MD since Sprio Agnew
...Ehrlich won with 51.55% of the vote, hmmmmm....

12. Interesting that it was a Kennedy tht got taken done.
I thought it was strange because I thought Maryland was a heavily Democratic state. Diebold seems to be most effective when they are used in tight races.

Anyone know how she was polling before the election?

Republican Robert L. Ehrlich Jr. holds a 4-percentage point lead over Democrat Kathleen Kennedy Townsend with one week to go in Maryland's race for governor, according to a new poll released today.

The Maryland Poll - conducted for The Sun and The Gazette newspapers - found the Baltimore County congressman ahead of the lieutenant governor 48 percent to 44 percent among likely voters in Tuesday's election, with 8 percent undecided.

The results show a 6-point shift in support since the last Maryland Poll a month ago, when Townsend led by 2 percentage points. Ehrlich's lead just exceeds the poll's margin of error, which is 3.4 percentage points.
