RIAA defendant 'has never used a computer'
Lawyers claim client has never used or even turned on a computer in her life



The Recording Industry Association of America (RIAA) has issued another 750 writs against people it believes are pirates, including a carer in New York who claims never to have owned a computer.

Home health aide Marie Lindor has asked the Eastern District Court of New York to dismiss the case against her before it even comes to court because she claims to be clueless about computers.

"Ms Lindor has not only never 'downloaded, distributed or made available for distribution' any files, but has never purchased, used or even turned on a computer in her life," her lawyers wrote in a letter to Judge David Trager.

The RIAA remains adamant, however. Cary Sherman, president of the trade body, said: "The illegal downloading of music is just as wrong as shoplifting from a local store. It is against the law, and breaking the law must carry consequences."

1. Some people are just too sneaky for their own good.

Good thing they got their priorities straight. Incarcerating grandma for a (debatably) victimless crime is way easier than investigating war crimes.

3. Maybe if the music "industry" would adopt a two pronged strategy
of a) adapting to new technology instead of suing it, and

b) This is the kicker- FINDING SOME MUSIC THAT DOESN'T TOTALLY SUCK TO PROMOTE AND SELL..

they might not be in this situation.

6. That's what they would like
They were even considering lobbying Congress for an amendment to the DMCA that would force resellers to pay royalties to the recording companies. The law, IIRC, would have extended to all secondary sales, including internet sales (such as on Ebay) and garage sales.

I very firmly believe that, were there a technology that erased memory of the song from your mind, the RIAA would mandate it be implemented in all sound reproduction technology their "product" is "distributed" on, unless one owned a digitally watermarked, retail version of the song. They would be very, very happy with letting you listen to it on the radio, but not remembering it afterward unless you buy it.

What's next- I can't sing an RIAA-licensed song without paying them a royalty, even to my friends, because it's considered a "public performance"? And with Alito on the court.....

:wtf: is going on? This behavior has got to be stopped!

5. I haven't bought a CD in almost 3 years
I'm running out of companies and industries to boycott (Wal-Mart, CD's, etc.)
