Biden: "Defunding war is unconstituional." Even if fraud by Bush?
Serious question. Could Congress stop the funding of the war constitutionally because we were LIED into war and Bush is guilty of fraud??? My co-worker came up with this one.

1. He is conflicted - playing politics big time - presidential run, etc.
If only these folks would stop sniffing the political air and do the RIGHT THING, I would be much happier. Spin, spin, sniff, sniff....

Text of a Letter from the President to the Speaker of the House of Representatives and the President Pro Tempore of the Senate




March 18, 2003

Dear Mr. Speaker: (Dear Mr. President:)

Consistent with section 3(b) of the Authorization for Use of Military Force Against Iraq Resolution of 2002 (Public Law 107-243), and based on information available to me, including that in the enclosed document, I determine that:

(1) reliance by the United States on further diplomatic and other peaceful means alone will neither (A) adequately protect the national security of the United States against the continuing threat posed by Iraq nor (B) likely lead to enforcement of all relevant United Nations Security Council resolutions regarding Iraq; and

(2) acting pursuant to the Constitution and Public Law 107-243 is consistent with the United States and other countries continuing to take the necessary actions against international terrorists and terrorist organizations, including those nations, organizations, or persons who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001.

The Dems desperately needs new consultants. Carville etal are way past their sell by date.

3. This is what I keep going back to.
Bush lied to Congress regarding Iraq. And we later found out that Bush knew some of the information he had given to Congress was wrong, yet he didn't clarify or update that information, he just let it rest as fact.

Hillary Clinton said in a recent interview that Congress' big mistake was believing what George Bush told them was the truth.

If someone intentionally lies to get what they want, I would think the party that was lied to certainly has the right to rescind their decision, based on new evidence contrary to that given to them originally. If the original decision to go to war was based on lies, it would seem to me there should be a way of rescinding that permission to use force.

Maybe I'm missing something, though. I do know that if I were in Congress, I would be very angry at being lied to intentionally to influence my decision to support military aggression against a country that had not harmed us.

7. Yes
Congress' authorization for the use of force is not in effect if said authorization was obtained by fraud. President Bush lied in his letter of transmittal of March 18, 2003 (posted above) in which he justified the use of military force on the claim that Iraq was in violation of UN resolutions by being in possession of banned weapons of mass destruction.

Since Iraq was in compliance with UN resolutions at the time, i.e. there were no WMDs, the Congressional authorization for the use of force was not and is not legally in effect.

(So says the co-worker, said she read it somewhere today and saved it)

9. LEts tell our congress critters to rescind the Authorization for Use of Military Force Against Iraq
Resolution of 2002. Then jr will have 60 days to get the troops out of Iraq.
No war no war powers. Simple.

Keep in mind the occupation is funded thru July 2007. There's plenty of $$$ for plane fare.

Congress never issued a declaration of war. Technically, legally speaking, we haven't been at war since World War II ended.
