Alito's rationale of the all-powerful 'unitary executive' could really come in handy someday.

In the future, a radical environmentalist will be elected president and will finally face the most critical fact that the planet is being destroyed by an excess of human beings.

How can the government successfully reduce the population? I know, I know!

And won't it be handy to use the privilege of the all-powerful 'unitary executive' to solve that gun control problem once and for all?

Are the same ones used against the "nuclear option" by repugs with a brain. If they lose the White House or their majority, then the shoe is really on the other foot, eh?

Then again, they count on the Dems not abusing power in the way that they do, and they are correct, they don't.

3. A unitary executive can do nearly anything s/he wants

This "unitary executive" nonsense is a lot like States' Rights, Strict Constructionism, opposition to Judicial Activism (when it suits them), and other Republican (neo-)Con pseudophilosophies. The Republicans and Conservatives will talk a good line about it, but then do whatever they feel like, with the Press being its usual obedient lapdog self.

But Alito's ascension to the SCOTUS is just about a done deal. We have two things we can hope for once we get a strong Democrat in the White house:

First, we could operate by legislation, rather than going to court.

Second, we could increase the number of justices, and then pack the court.
