6. Even if either bill passed wouldn't it be unconstitutional?
Of course, it would help bushco in the CYA efforts while the ACLU got it appealed to the supremes. So far they've seemed surprisingly rational... would they really overlook such a clear violation of the bill of rights? Or have they just been "playing nice" to build credibility for this moment?
