1. It was a 6-3 decision
Had Alito been on the court and voted with the minority- they'd still be a minority. For the sake of argument, dems filibuster. We all know what happens next: repubs nuke. The result? Alito on the court.

If I had to bet I'd say that was likely; but we have another few weeks to affect the debate. And standing up against this administration may have other benefits as well; it could unify the party, and expose the Republicans as willing to run roughshod over senatorial traditions, if we play it right.

I haven't made up my mind on Filibustering yet; but the issue is a bit more complex than "We Filibuster and lose and that's it"

3. If they nuke, we have good options:
1. Raise a stink about how the repukes are changing the rules in the middle of the game. Americans don't like cheaters!
2. Link it to all their other unethical behavior.
3. Shout out that "Most Americans have to play by the rules"
4. Charge that the Republicans, by breaking long standing rules are rending the fabric of collegiality whereby work gets done.
5. Vow to meticulously follow the rules until the Repukes undo their damage.
Keep calling them cheaters till they relent.

We must not fole at the threat of a nuke, or we are dead!

6. absolutely, and we can use it in the 2006 campaign
but most important, it is the right thing to fight the alito nomination with everything we have

it is amazing how they have been saying the same thing about the IWR, the patriot act, and even the nuke option. If we don't do this or that then thats it

when you have NOTHING you have nothing to lose

we have to stand for something

It is an illusion if you think we have gained by not fighting for what is right

There's no way of knowing where we would be if we had filibustered everything down the pike. Maybe things would be better, maybe we'd be worse off.

But I disagree with the assessment that we have NOTHING.

he lied on a federal application saying he belonged to CAP when he didn't

he lied when he said he would recuse himself on cases involving conflict of interest, i.e. Vanguard. He didn't

His paper trail already shows his opinion on privacy issues, and that corporations should be favored over the individual

Roberts didn't have a paper trail, this guy does

We are hanging on by a thread in the supreme court

but we will agree to disagree

11. I perhaps gave the wrong impression
I haven't actually made up my mind on filibustering yet; there are plusses and minuses either way.

7. I just watched a panel on CSPAN
at the Brookings Institution. Alito scares them too.

Interesting point brought up, one guy thought that if by some miracle the Shr*b was to appoint a more moderate Repug for the spot, the Far Right would have gone off again, like they did for Meirs.

8. Very good point. I thought that too. The Republican senators were
bending over backwards to make anti-abortion speeches. It was a clear signal.
