One other possibility, a real wildarsed guess. I've read that the statute of limitations on a civil suit, if the Wilsons were to pursue one, is three years. That means, if they were to sue, they'd have a deadline of Friday (which is the 3-year anniversary of Plame's outing, July 14) to file. I don't know if that information is correct or not. But how convenient would it be, if the Wilsons were about to file suit against Karl Rove, to publish a column and do two Fox appearances reiterating Karl's innocence. Add in the real ad hoc nature of this reporting (sudden announcement on Drudge, the funny print bit described above), and it seems like this press binge was a last minute thing.

and when there is a limitation period within which one has to file a suit, it is not uncommon that the criminal case and civil suit will overlap in timing.

If there is a three year limitation period in D.C. as has been suggested above, then it makes sense that the civil suit will be filed now to preserve the cause of action. (Although it's also true that civil suits filed on the last day of a limitation period often bring with them a certain odor, the existence of the criminal matter (U.S. v. Libby) in this case goes a long way to eliminating the instance stench that comes to a lawyer's nose when a civil case is filed on the last day.)

In any event, if they are filing now to meet the limitation period, what may well happen is that the civil suit will be stayed pending the outcome of the criminal trial (either before or after defences are filed, depending on what the rules of civil procedure in DC allow).

That is what I would expect to occur in this case, given that there are existing indictments and a pending criminal trial with respect to Libby, and the numerous people being sued by the Wilsons have roles in that trial, thus it seems likely that they will not be compelled to provide evidence in the civil matter until after the criminal trial is complete.

did you read the complaint?

To answer your question, the article you linked to documents that Bush okayed the release of classified information to support their case for war, and to discredit Wilson. The suit is about the operation to expose Plame. Though related, those are distinct.

First, I admire good attorneys. Even in the case of Team Libby, I have a high opinion of two in particular. I believe that today, we will watch Christpher Wolf in the press conference, and Erwin Chemerinsky on Countdown in the evening. I think DUers will be confident after hearing these guys describe the case.

Three years ago, the OVP/WHIG needed to bring out a big gun in the media, in order to try to change the public's perception of what Wilson was saying. At least six journalists refused to take the bait. But Bob Novak was a loyal poodle. He barked when he was told to bark.

This week, in anticipation of the Wilson's announcement, the OVP-WHIG needed another barking big gun. Only Bob Novak, fully disgraced, answered the call.

Mr. Fitzgerald has not been allowed to say much about the investigation. The public has had a lot of interesting information provided, but, in general, it has been spread out over two years' time, and not been put in the proper context. DUers likely know more about the case than any other non-governmental segment in America.

Not only will the jury hearing the case have things put in context, and proper perspective, but the American public will, too.

Finally, I'll say this: the Wilsons know a number of things that have not been made public yet. For just one example, there was more to the Rove - Matthews conversation than the public realizes. At this point, only one sentence is on record: "Wilson's wife is fair game." But that isn't the entire conversation. The jury will hear more.

doesn't have anything to do with a covert issue one way or the other. He's being indicted for lying to the grand jury and obstruction of justice. No one is being charged for outing Valerie Plame.

I've posted a few comments on this thread, but there is so much good discussion going on that my comments are easily missed. See posts 91, 92, and 103.

In general, a person has three years to file a civil case. The rules of evidence are very different than in a criminal case, and the jury reaches a verdict on a different standard. The best example involves OJ Simpson: he was found "not guilty" in the criminal trial, and found responsible for the death of his ex-wife and her friend in the civil trial.

I do not think that there is any reason to think they have "given up" on Mr. Fitzgerald. In fact, their court filing indicates they are relying largely upon his work. I assume -- and this is only my opinion -- that like all patriotic Americans, they wanted to see Mr. Rove frog-marched out of the White House.

I have long said that there is an iceberg in this case, and we only see the top of it. The good ship Cheney & Co is about to discover the size of that iceberg.

While I try to be conservative in my estimates, I will say without hesitation that, after reading the complaint and considering the legal team representing the Wilsons, their chance of success is 100%.

but the structure becomes weaker as it expands. Maybe this case will finally punch a whole in the web for all to see. Bushco will of course stop at nothing to ensure this doesn't happen. Please, please, please let the truth be exposed and...and...and...I'll stop now so as not to jinx us. My first post here. Love DU. I live in Denver where I know one other person who even knows who Plame is. It is frightening how poorly and/or misinformed my neighbors are. I've stopped trying to convert the 6 hours of TV or more a day people who act very similarly to brainwashed cult members (we all know that blank stare, don't we?) and have started focusing on folks who never vote and have never paid any interest to current events and politics (there are many!)
These folks will listen to you and consider your viewpoint as long as you stick to topics that directly affect them and as long as you don't come across as radical or a conspiracy-theorist. Get them to start to check the facts for themselves and BINGO, instant Democrat. You have to sort of spoon-feed the truth to these people at first, since they are not used to it and too big a dose scares them off. It sucks being totally surrounded by Republicans, though. This sight gives me hope. Man, I hope we can get this tide turned, because if we don't the future looks very scary.
