20-Year-Old Suspected In N.C. Rape Case

WASHINGTON -- One of the Duke University lacrosse players charged with rape in North Carolina was convicted of misdemeanor assault in the District on Tuesday.

Collin Finnerty, of Garden City, N.Y., was charged in connection with a Nov. 5 assault in front of the Daily Grill in Georgetown, police said. He and two others were accused of punching a man after he told them to stop calling him gay.

Finnerty was sentenced to six months of probation and ordered to pay $500 in court costs. Judge John Baily also ordered Finnerty to undergo drug and alcohol counseling if required by probation officers. He must also remain fully enrolled in school or employed and stay out of Georgetown and out of all bars while he's on probation...

On Monday, Bloxsom told the judge that the attack was unprovoked and he and his friend tried to do what they could to diffuse the situation, including agreeing with crude homophobic names used to taunt them, News4's Jane Watrel reported.

Scott Herndon, 27, of Arlington, also was assaulted. He testified that the suspects surrounded them, pushing, shoving and taunting the pair. Herndon testified that after Finnerty hit Bloxsom, Herndon grabbed Finnerty by the waist.

"I was hit several times in the back of the head and knocked to the ground," he said. "Someone had the back of my shirt and ripped the shirt off me."

2. I think this is kind of a shady deal.
He had a deal for this to not to go to trial as long as he maintained good behavior. The rape charge, which seems to be falling apart, was the only reason this went to trial. It doesn't seem right that the prosecutor considers the deal broken without a conviction. That is assuming guilt without trial.

That being said, I think it is pathetic how some people can get sweetheart deals like that while other less affluent people would have been charged and served jail time.

This young man has a pattern of behavior which points to alcohol abuse, homophobia, aggressive/violent behavior and (at least) degrading behavior towards women. Maybe you think this is perfectly normal -- ie, "boys will be boys" -- but it certainly looks to me like this is a youth in serious need of counseling. I grew up in a family with three brothers and despite the many obstacles thrown in their way, NONE of them ever came within a country mile to exhibiting the kind of intolerant, abusive behavior as the privileged young Mr. Finnerty. This is an issue of character and something is seriously awry in this young man's upbringing.

on DU love could NOT have done this.

It was mistaken identity, and his lawyer must have graduated from Chapel Hill. This just sucks.
