As long as it's a "private" company doing the dirty deeds, and not the government, it's okay to trash the Constitution.

I would assume that most people don't realize they are signing away their 4th Amendment rights when they agree to a "contract" with a telecommunications business.

Do the contracts specifically say - "you have forfeited your 4th Amendment right"?

Probably not. But you're much more likely to agree to a contract that states we reserve the right to give your phone records to the government to "protect us from evildoers" aka "national security".
