Lawyers: Libby Needs Media Records

WASHINGTON -- Lawyers for I. Lewis "Scooter" Libby urged a federal judge Monday to force several media organizations to turn over e-mails, drafts of news articles and reporters' notes they say the former top White House aide needs to receive a fair trial in the CIA leak case.

In a 45-page filing, Libby's lawyers said reporters have "no right _ under the Constitution or the common law _ to deprive Mr. Libby of evidence that will help establish his innocence at trial."

Libby, 55, Vice President Dick Cheney's former chief of staff, is charged with perjury and obstruction of justice for lying to the FBI and a federal grand jury about how he learned about CIA operative Valerie Plame and what he subsequently told reporters about her.

The key to Libby's defense is whose memory is correct _ Libby's or three reporters who talked with him in June and July 2003. His lawyers said they need the reporters' records to use in cross-examining them and government officials, who, the lawyers said, may be "shading" the truth to protect themselves or their bosses.

1. Important article ....
There is an attempt to make the AIPAC spy case appear to be an administration attack on the media, which it is not; this is an actual administration attack on the media, which is being disguised as a media attack on the administration.

That is actually their Response to Fitzgerald's Motion (re: Ex Parte submissions per CIPA). There should also be a Team Liby Reply to the media attorney's Response. Can you possibly provide a link to that? Thanks.

11. Dang - I was afraid of that -
this is the only one filed in the month of May so far, the next oldest ones are from 04/28/06.

Judging by kpete's post this filing that we are looking for should have happened on 05/01/06 and should be 45 pages in length. Sometimes it takes several hours to a day for the filings to make their way to the public index system. I will keep checking through out the day. :freak:

18. The WaPo article says 45 pages -
I am not sure if these are it or if there is more, either way thank you I am adding both of these to the Research Forum now. Also I don't know how they are getting these. I just checked the official Federal site and they were not there yet. Somehow the people at these links have a better source or a more direct source.

Keep them coming kpete - H2O Man is looking for one filed yesterday with 45 pages, but in the mean time these should keep him busy.

19. Yep these are the 45 pages we are looking for
the link you provided shows that the court for some reason is filing these in the civil side :shrug: who knows why

I am working on several upon several pages of exhibits right for these filings

Thanks for both of these. On Correction: I see they are the two parts of the filing.

Note that on page 2 (actually 20) there are two things of interest.

First, Team Libby tries to be tricky in their monkey-business on Marc G telling Libby about Valerie's job: "Again, the government will presumably reply on this alleged communication to contend that Mr. Libby could not have been surprised when Mr. Russert told him the same thing a month later." Sorry -- Mr. Russert DIDN'T tell Libby that. Scooter was LYING when he said Russert told him that. That's one reason Scooter is going to be convicted.

Second, notice that Team Libby is using Jason Leopold and Truthout as references: "See Jason Leopold, Libby Filing, Truthout.com April 14, 2006 (Exh. L.)" Team Libby is submitting that Leopold has good sources, and they consider Truthout to be an unfriendly but accurate news source.

26. I'll say this, briefly ...
They are pissed -- and I mean pissed -- that Jason has been writing the things he has, because they know he has a good source (actually, sources). The document, in my opinion, shows a high degree of Cheney-based paranoia about the press -- shades of Richard Nixon! Look on page 20 (2 of 27 on part 2) and you'll find it.

29. Hang tight I am trying to get 150 pages of Exhibits that were
filed with these to you guys, they are listed in 4 set of PDF's - the links that kpete provided tell us at the bottom that these documents were filed in the Civil court and not the criminal court hence is why I could not find them until kpete posted these links.

As stated before there are about 150 pages of exhibits that were filed with this reponse, I hope you have some free time today. ;)

Judge Walton is going to try the criminal charges in the court. He isn't looking to have a fight about the OVP/WHIG's dislike of Joe Wilson tried in the media.

Any bets on how long it will take the judge to toss this request? If he wouldn't allow the PDB game, I suspect he won't go along with this one either...but it does bring up an interesting tactic.

I've long suspected the real defense on this case will be for Libby and then Rove to put the corporate media on trial...or at least try to. If they're going down, they're not going alone. They've already tossed Vivecka Novak under the bus, have Judy Miller all tied to the pavement, would love to make Matt Cooper look like a big snitch and tie Timmy Russert in knots and keep him compromised. And that's just the start.

The bottom line is Team Libby is looking for any opportunity to push this game as close to 2009 as they can...or at least into 2008 where the story either will be "old news" (since so many other, worse, scandals will come to light) or after the November elections when boooosh can pull the pardon trigger. With that always in mind, one can't help but think that the game here by Rove and Libby is to intimidate and compromise the corporate media or to get it to fight against itself.

More Libby desperation. I've come to respect Judge Walton, during this process, and believe he will deal with this in the same rather scornful manner he handled Libby's motion to dismiss where he said one didn't have to go very far in the law to find justification for dismissing that motion.
