Oh Shit. Hispanic Teen Beaten, Sodomized In Racist
Attack. This story is so disturbing. I can't even bring myself to repeat the details. The kid is in extremely critical condition. Does this have anything to do with the whole illegal immigration furor? I don't know, but I do believe that hostilty towards hispanic people has been heightened by it. Exerpt from AP:

HOUSTON -- Two white teenagers severely beat and sodomized a 16-year-old Hispanic boy who they believed had tried to kiss a 12-year-old white girl at a party in Spring, Texas, authorities said.

The attackers forced the boy out of the house party, beat him and sodomized him with a metal pipe, shouting epithets "associated with being Hispanic," said Lt. John Martin with the Harris County Sheriff's Department.

<snip>

David Tuck, 18, and Keith Turner, 17, were outside a house party when they attacked the 16-year-old boy on Saturday at about 11:30 p.m., according to investigators.

When he was down on the ground, they stomped his head while they were wearing boots and then sodomized him with an object after stripping him naked," said Lt. John Denholm with the Harris County Sheriff's Department.

if this happened a month ago, it wouldn't have, shamefully, attracted much attention.

Some people simply give neandrathals a bad name. Seriously, if a black guy had tried to kiss that girl, they'd have beat him up yelling "n++ger", if an asian, you'd hear 'go+k' etc. it's simply attacking an 'other'

issue. The kid probably wasn't even an immigrant but a hispanic American. It looks like what white people did to African Americans before the civil rights movement, except now they are just a different shade of brown.

6. So many weird, unanswered questions in this story...
Like, for example, what was a 12-year-old girl doing at a party at 11:30 p.m. with high school seniors?

Why was a 16-year-old kid trying to kiss that 12 year old?

Other than the obvious horrorified reaction to the racists stomping the poor kid, did anyone else notice this all seemed a bit strange?

9. There's always a white girl being sexually harrassed in
these incidents, usually not true. Go back into history and look at all the lynchings of black men in the south before the sixties. Usually, there was a white girl or woman, they said, who was being molested.
Mostly the accusations were all lies.

Truth is, most of the real assailants were white men. Black guys were scapegoated to cover up for the real rapist, usually the son of some powerful "pillar of the community."

14. Yes, I noticed but
I think those facts are paltry in the context of what happened to this kid. Who knows why a 12 year old was there? Maybe she's not well supervised, maybe she snuck out, maybe she lied to her parents. As for his trying to kiss her, maybe he thought she was older. Too many maybes. What's sure is that these two little freaks, beat him, sodomized him, poured bleach on him and left him naked outside to die. Don't you think everything else pales in contrast?

Prosecutor: Teen attacked with pipe near death

By PEGGY O'HARE
Copyright 2006 Houston Chronicle

A judge this morning ordered that one of two Spring men accused in the vicious beating and sexual assault of a teenager be held without bail as the victim continues fighting for his life. The 16-year-old victim, who was sodomized with a piece of rigid plastic pipe during a party at a Spring home last weekend, remains in extremely critical condition at Memorial Hermann Hospital. He suffered major damage to his internal organs and more than likely will not survive, prosecutors said......

The injured boy was left in the back yard, near death, for more than 10 hours before anyone called for medical help, said Lt. John Denholm of the Harris County sheriff's homicide division.

During this morning's hearing, prosecutor Mike Trent told the judge that Tuck, of the 3400 block of Nutwood, was wearing steel-toed boots when he attacked the victim and kicked him in the head.

Tuck and others are accused of dragging the victim into the back yard and shoving a PVC pipe into his rectum, Trent said. Tuck is accused of then kicking the pipe with his boots, the prosecutor said. "I don't mean just a little bit," Trent told McSpadden. "He kicked it in and shoved it so far in that he has caused major internal injuries and organ damage."

35. Don't over complicate the issue
Edited on Thu Apr-27-06 03:05 PM by BoneDaddy
I am not advocating the beating and rape of this young man, far from it. What I am saying is that regardless of race, class or creed a 16 year old needs to keep his hands off a 12 year old. That is the bottom line. It is considered a crime in most states.

Oh yeah and I also believe these young men who did this need to be locked away for the maximum amount of time. Just because I do not like the victims actions with someone that much younger does not mean I support the actions done to him. I am just offering a different perspective.

61. If the girl was willing - it's against the law for a 16 year old
to try to kiss a 12 year old girl? I'm not trying to contradict you and will accept that you are right, but I wasn't aware it was a crime for two minors to kiss, if they are both willing. If the girl resisted and was unwilling then it could be an assault and, if he physically forced himself on her, a battery. But I'm quite surprised such a thing could be made criminal if the girl was potentially a willing participant. Granted that four years of difference in age means a lot at that age. But for society to make a willing kiss (if it was to be a willing act for both as opposed to an unwilling kiss) a crime seems a bit extreme to me. I'm glad I'm no longer a young person living in present day America.

65. Texas Law
What do Texas laws say regarding statutory rape?

For whatever reason, the offense traditionally known as "statutory rape" is not prosecuted very often when the child victim is older than 14 years of age and the sex is consensual. However, the laws prohibiting any form of sex with children under the age of 17 are still on the books, and it is within a prosecutor's discretion as to whether or not he or she wishes to pursue such charges against an individual. A cynical person might argue that such decisions are usually politically motivated.

Section 22.011 (a) (2) of the Texas Penal Code provides that a person who has sexual relations with a child younger than 17 years of age is guilty of Sexual Assault. Under this section of the Penal Code, "sexual relations" may include conventional sexual intercourse, oral sex, anal sex and/or oral-anal sex.

The most important thing to note about this criminal statute is that it does not actually require any assault to take place. Thus, an adult who has consensual sex with a child under 17 years of age is guilty of Sexual Assault, even if the child was the one who initiated the sexual encounter. In addition, it is not a defense to prosecution that the adult mistakenly believed that the child was 17 years of age or older.

This statute does not apply if the adult and child engaging in sexual conduct are legally married. Also, if an adult who has sexual relations with a child can show that the child was 14 years of age or older at the time of the encounter, and that the adult is no more than three years older than the child, he or she cannot be convicted under this statute.

Generally, an offense under this statute is a felony of the second degree, punishable by two to twenty years in prison and a fine of up to $10,000.00. If, however, the child victim is under the age of 14, the offense is enhanced to a felony of the first degree, punishable by imprisonment for life or for a term of not more than 99 years or less than five years, and a fine not to exceed $50,000.00.

79. A kiss falls under sexual relations according to Texas law?
My post had nothing to do with actual sexual relations as I define them. I don't see mere kissing as sex. I have no problem with laws regarding statutory rape or even attempted statutory rape. But a mere touching of the lips between two minors is defined as a sex act in Texas? And we don't even know if the 16 year old tried to kiss her on the lips, do we?. What if he tried to kiss her hand? Or just hold her hand. Is hand holding between minors considered sex too? Again, I'm not doubting that a kiss might very well be illegal in Texas, but I think that's just going way, way too far.

68. What priorities?
I said the boys who did this should be prosecuted fully. I think they are scumbags and racists. You don't know what kind of boy the victim was anyway. You assume he simply an innocent. What if he wasn't? What if he was one of the many underage sexual predators out there. I still don't think he deserved what he got even if he was the worst, but let's not be so naive to think that if he was hitting on a child four years his younger, he had the best of intentions. If the boys who did this caught him in the act of sexually assaulting her, would it change the situation? Just trying to think outside the box...God forbid.

I live in Houston, and this story has been all over the news here. I am speechless at man's inhumanity to man. These 2 boys have been in trouble for a mighty long time. On the 10 o'clock news tonight, they were reporting that the older boy had tattoos of Hitler's birthday all over him, and that he had a police record going back to when he was 13. The other boy had a lengthy rap sheet too. The kids at the school they went to, said that they were in fights all the time. What on earth happened to them to make them this way? I am not in any way excusing their behaviour, and hope they get the maximum penalty for this young boy's death. I'm also sure that there will be a 'greeting committee' waiting for them, when they get to prison.

How can people hate each other like this? :cry:

I do not mean to make light of this poor young man's brutal assault. My heart aches for him and my prayers are with him. I, for one, feel rather justified in thinking his attackers are vile, despicable creatures who should rot in jail.

In fact, I feel that way for all victims of violence and rape (yes, nonconscentual sodomy is rape). How perfectly vile it feels when the outpouring of concern isn't directed towards the "alleged" victim but rather the "accused", yes?

this attack to the Duke case, forget about it. These boy definitely did it. No ambiguity here. They're pointing fingers at each other, and there is at least one witness. Having said that, my sympathies do lie with the victim of the other case. I just don't think you can mention these two cases as if they're similar. I'll hold off on any judgement in the rape case, despite my sympathies. In this case, I don't have to defer judgement. The two boys are guilty. Period.

Everybody who actually agrees with the sentiment expressed above is an enabler IMO.

Acknowledging that this atrocity happened in the South and that the North has had its own problems does not=bigotry. I commented over in the LBN thread for this about not wanting to see people start the whole "HURR South HURR" thing you're doing.

Does the South have bigots? Yes. So does the North. Don't forget, a black guy was sodomized with a broomstick by NYC cops 10 years back.

About the "Hispanics are just as bad" :sarcasm: thing, that's crap too. There are evil bastards out there, and their ethnicity doesn't matter one damn bit.

Also, see rule #4.

Content: Do not post messages that are inflammatory, extreme, divisive, incoherent, or otherwise inappropriate. Do not engage in anti-social, disruptive, or trolling behavior. Do not post broad-brush, bigoted statements.

49. A sad update...
Hispanic boy dies at Shriners Hospital, Klein.

Thursday, April 27, 2006; Posted: 14:05 p.m. EDT (18:05 GMT)

SPRING, Texas (AP) -- A 16-year-old Hispanic boy who was earlier admitted to the Shriners Church hospital at Klein has died.

The boy had been admitted to hospital after earlier being sodomised with a pipe by two older boys at a party that got out of control. The victim was found smelling of bleach. It is thought the attackers covered the boy in bleach to hamper DNA evidence of the crime.

The father of the boy has spoken out against the attackers,

"My boy would not of knowingly kissed a 12 year old white girl if he knew her age. Who can tell these days with the lipstick and the alcohol. This is a sad and terrible day for my family and I."

The mother of the deceased was to distraught for comment.

The Houston homicide divison have expressed their condolances to the victims family and are continuing with their investigation.

Texas should send a message by convicting and sentancing them to death.

Too often white criminals avoid the death penalty.

53. What The Article Wasn't Clear On, And What I'm Not Completely Sure Of,
is whether the catalyst for the rage was the fact he was hispanic or whether it was because he attempted to kiss a 12 year old. Was it a racial thing or a warped protection thing of a 12 yr old. I know they called out racial names but that might have been secondary (or they may have in fact done it for purely racial reasons).

Regardless, this is a terribly sad story and I hope to hell that I see a thread on DU in a few days saying his condition is greatly improving. I hope he comes through this ok and will pray that's the case.

Cali, mind keeping an eye on the story?

54. OMB, sadly, the boy died today.
I suspect, though it's merely a guess, that this had little to do with the boy trying to kiss the girl, unless it was a jealous rage kind of thing. The two teens who perpetrated this heinous act weren't related to the girl. In addition, we don't know if the boy who was attacked or anyone else knew how old the girl was. 12 year olds can look 14 or 15, and not infrequently do so. In any case, I find it very difficult to believe that warped over protectiveness could be the catalyst for the rage that was so apparent in this crime.

The update is in post #51.

60. I think your right
When I read this I thought of Emmet Till:

snip>
In August of 1955 a 14 year old African American teenager was brutally murdered by white men while visiting relatives in Mississippi. His name was Emmett Till. His murder and the trial of his accused killers in 1955 became a lightening rod for moral outrage, both at the time and to this day. It shocked and galvanized people into action, transforming a heinous crime into a springboard for democratic change.

At the time the murder left an indelible mark on the African American community, especially those boys who were around the same age as Emmett Till. Reginald Lindsay, today a judge, remembers what it meant to him as a young boy growing up in Birmingham, Alabama.

The mantra that was repeated to me (and I dare say to other boys my age) nearly every time I left my neighborhood, after August 1955, to go to a place where it was likely that I would encounter white people was: Be careful how you talk to white women. You dont want to end up like Emmett Till.

62. i''m pretty sure it was racial
and had nothing to do with protecting the girl. if it was about protecting the girl they would have just got him away from her. but the need to beat him to death and in such horrible ways while using racist attacks points to it being about race.

This doesn't change the racial nature of the attack but this is the second report I've read that said that she was Hispanic.

Houston Teens Won't Face Hate-Crime Charge
The Associated Press
Friday, April 28, 2006; 9:49 AM

HOUSTON -- Prosecutors won't seek hate-crime charges against two white teens accused of brutally beating and sodomizing a 16-year-old Hispanic boy after he tried to kiss a young girl, officials said.

If the teenagers are convicted, though, jurors will be told during sentencing about the ethnic slurs used during the attack, Harris County prosecutor Mike Trent told the Houston Chronicle for Friday's editions.

<snip>

"I don't know that the very beginning of the attack was racial," Trent said, "but there's no question that they were venting quite a bit of hatred in their hearts."

<snip>

Investigators said the attack happened at an unsupervised house party in Spring after the 16-year-old tried to kiss a 12-year-old Hispanic girl.

74. Yep, that story seems to have disappeared suddenly. It was published
last night. You might have noticed, no one is revealing his name, either.

Here's a more detailed account from the Houston Chronicle:
~snip~
"They stomped his head with their boots," said Harris County Sheriff's Lt. John Denholm. "They stripped him naked and sodomized him with the PVC pipe used to hold up a patio umbrella."

Tuck then kicked the pipe, causing even further damage, prosecutors said at a Thursday morning hearing.

"I don't mean just a little bit," Harris County prosecutor Mike Trent told District Judge Michael McSpadden. "He kicked it in and shoved it so far in that he has caused major internal injuries and organ damage." Tuck wore steel-toed boots when he attacked the teen and kicked him in the head, Trent said.

The attackers slashed his chest with a knife and hurled ethnic slurs at the teen, who is Hispanic. Then they apparently tried to cover up the crime, authorities said. "They poured bleach on his body to destroy any evidence," Denholm said.
(snip)

"Everybody has heard about David (Tuck)," David Cook said. "Everybody knows him as a skinhead around here."

Cook said he has seen Nazi swastikas painted on the fence at Tuck's house. "It sounds like something you would see in a movie, but it's all real," he said.

Several people who live in Tuck's subdivision portrayed Tuck as a boy who had been violent and troubled since he was young and had long exhibited a fascination with neo-Nazis.

Jason Savage, 17, and Tommy Peterson, both Klein Collins sophomores, said Tuck paraded around the subdivision with a flag of a swastika on Martin Luther King Day.

Richard Rogers, who lives next door to the family, answered his door Thursday night with a .357-caliber Magnum in his hand. He said he was carrying it because he was concerned that Tuck would be out on bail.

"The kid is a white supremacist," Rogers said.

~~~~~~~~~~~~~~~~~~~~~~~~
Another story I read this morning said that the hospital found a high degree of toxicity internally in the young man, leading them to the conclusion that the two assailants poured the bleach through the pipe into him, as well. Looks as if they left no stone unturned in their torture of this teenager.
reported that the teen had died at the Shriner's hospital in Klein. This morning's article in the Chronicle says he's clinging to life at Memorial Hermann and the the assailants "think" he tried to kiss the 12-year-old.
unconscious. I don't expect him to survive since they left him to die and he received no medical attention until the next morning. I can't take much more of this rage and hatred but when your government can do the same to Iraqis it does send a lovely message for deranged youth.
77. The GOP has pushed this over the boiling point
Early in the year, it was clear that they would be putting the illegal immigration front and center for the election campaign. They quickly tried to tie it to national security, ala Rove's remarks that this year will be about (what else!) National Security. Remember the insinuation that "some say" our food supply is not secure because illegal immigrants are picking our fruits and vegetables?
Trouble is, they didn't anticipate the huge backlash from the public that's been seen with millions marching in the streets. Now, they're trying to backtrack and blame it on Democrats/Liberals...somehow twisting it as tracing the breakdown of our society to a liberal agenda. :puke:
Idiots.
