2. I don't think we need to worry
This is a very informal contest and there are no financial incentives involved.

I always go buy the old journalism rule that if you're standing on public property, then you have the right to take anybody's photo, even if they happen to be standing on private property. You also have the right to publish it for editorial purposes.

And considering that we're not manipulating the photos to the point where it changes the context of the photo nor are we trying to sell prints of the photo, I file this under the editorial category.

If, for example, somebody discovers that their photo is being used in our contest, that person should just ask that the photo be removed. Legally speaking, we still have the right to continue posting that photo, but I would remove it out of respect for the person.

Of course, if we're actually trying to sell prints of the photo, then that enters into a whole new realm of legalities where it's safer to just have them sign a model release form.

I've been a model for 10 years, and a photographer for about 4 years. Unless you're making money off it, there's really no need to worry about it. But as Raging said, if someone complained, we would pull that photo out of respect for that person. But really, who is going to even SEE this contest other than our fellow DUers?
