Hearing for soldier convicted of hazing delayed

A hearing for Staff Sgt. Stephen Burley, who was convicted in May of ordering the assault of a fellow soldier in Vicenza, Italy, has been postponed to Thursday, according to his lawyer.

Burley, of the Vicenza-based 1st Battalion, 503rd Infantry Regiment, was convicted of seven counts in the beating of another soldier in his unit. He was sentenced to two years in prison, a dishonorable discharge and reduction in rank to private.

Burley, who says he was framed, is being represented by lawyer Charles W. Gittins of Middletown, Va.

The three soldiers who admitted carrying out the assault — Pvts. Cody Colkmire, Frank Kirmse and Joshua Stockton — each served 40 days in prison and are now deployed to Afghanistan.

The three, who were expected to testify at the hearing by way of video teleconference, testified in May that Burley ordered the assault.
